The Wall Street Journal is reporting that the Federal Trade Commission (FTC) is preparing to sue the largest three pharmacy-benefit managers (PBMs) over their business practices related to rebates brokered with pharmaceutical manufacturers. This comes just after the FTC’s release of an interim report related to its ongoing study of PBMs, in which the agency claims that the increasing vertical integration and consolidation among PBMs may be negatively affecting drug prices, patient access to drugs, and independent pharmacies. This is a fluid situation that SciVida recommends biopharma executives monitor closely and have an informed perspective on, as there could be significant implications for pricing, contracting, and market access for their products. The FTC’s report cites that the three largest PBMs—CVS Caremark, Express Scripts, and OptumRx—manage almost 80% of prescriptions filled in the United States and that pharmacies affiliated with those PBMs account for almost 70% of specialty drug revenue. The FTC makes the case that dominant PBMs can strongly influence the price and availability of drugs and the pharmacies at which patients can access their prescriptions and believes that the insights it has gleaned so far from its study justify the continued scrutiny of PBMs’ role and influence in the US healthcare system. The FTC also suggests more is to come, as the agency notes that evidence about PBM and brand pharmaceutical rebating practices also warrants further scrutiny and potential regulation.
