The U.S. District Court for the Northern District of Texas has struck down the FTC’s blanket ban on noncompete agreements. Emily M. Dickens, SHRM Chief of Staff and Head of Government Affairs, asserts that this ruling reinforces balanced business practices that protect both workers and employers. “SHRM has been clear on this issue from the beginning, and the court’s decision affirms our position—like SHRM, the Judge recognized that the FTC’s sweeping ban failed to explore less restrictive alternatives and ignored the positive impact noncompete agreements can have when applied appropriately.” This decision not only blocks the rule from taking effect on Sept. 4th but also delivers clarity for businesses and workers alike. Stay informed and engaged as the landscape of noncompete agreements evolves. SHRM is here to support you with a range of resources to help you understand and apply these changes in your organization.
