"As rising interest rates and other challenges worry commercial property owners with loans nearing maturity, a running theme in the real estate industry is to “survive until ’25.” For hotel owners, however, the year-to-year struggle to stay afloat has been ongoing." Right-sizing a valuation and a tax bill can provide some breathing room for owner and operators. Read more below. #PropertyTaxes #APTCtax #TaxManager #HotelManagement

In a 1987 decision, Fred Siegel Co., LPA (now Siegel Jennings) argued and won a case that permitted a tenant to file a complaint in the name of the owner to seek a lower valuation. In commercial real estate leases, a tenant often has the responsibility to pay real estate taxes on the leased property. However, until a recent change in Ohio law pressed for by Siegel Jennings, only property owners could file a complaint. Name Brand Furniture provided tenants with a mechanism to seek fair and uniform valuation and hire their own counsel to fight for them. Name Brand Furniture Warehouse, Inc. v. Cuyahoga Cty. Bd. of Revision, 41 Ohio App. 3d 47, 48, 534 N.E.2d 366, 367 (1987). #PropertyTaxes #CommercialRealEstate #TaxManager
