"To truly define a good settlement, the likely outcome of a verdict must be quantified. This is because, in our world of litigated claims, a verdict is the ONLY alternative to a negotiated settlement. Drawing the red line, where you opt for trial rather than paying a penny more, is the only thing standing in the way of unbridled escalation of plaintiff demands."

"Poker, by contrast, involves decision-making under incomplete, imperfect, and often randomly generated information. Some information is known only to one side, some is shared, and some is unknown to anyone—like the next card to be dealt. Does that sound familiar?" What do you think?

    Are Insurance Claims More Like Chess or Poker? I've heard insurance claim professionals compare their strategic thinking and decision-making to playing chess. As a competitive and recreational chess player, I appreciate the parallels. Both chess and insurance require knowledge of the rules and an understanding of tactics. Both can be learned relatively quickly, yet offer numerous levels of expertise, each layered with complexity. Decision-makers improve with practice and experience. Additionally, success in both areas benefits from a combination of formal learning and practical experience. Chess players, for example, can learn from databases containing every rated chess game ever played by high level players, with board positions that might precisely mirror the current game. However, poker might offer a better comparison. In chess, the strategic field is one of perfect information: all pieces are visible, the board is fixed, and a complete list of legal moves is available to each player. While deciding the best move is not always easy, the player has a complete set of information. Poker, by contrast, involves decision-making under incomplete, imperfect, and often randomly generated information. Some information is known only to one side, some is shared, and some is unknown to anyone—like the next card to be dealt. Does that sound familiar? Claims professionals frequently deal with imperfect information, and certain elements of a claim are beyond their control. Prior claims serve as only a rough approximation of the current one and should be used cautiously. The poker player and the claims adjuster need to think probabilistically. In chess, if you make better moves, you win the game. But in both poker and claims, you can hold a strong hand, play it skillfully, and still lose. For this reason, claim professionals should be judged on the soundness of their decision-making process and long-term success, rather than on the outcome of any single claim. My views are shaped by experience and cumulative learning from many sources. One excellent book that expands on the comparison between chess-like and poker-like decision-making is Thinking in Bets by Annie Duke.
