    This past weekend I made an offer on a house. It brought back a flood of memories from 5 years ago. How the dreaded 'Best and Final' was my motivation for SparkOffer. This past Monday morning I received the call. "We have multiple offers and the sellers have decided to go to best and final." This process is broken and it sucks. I started building SparkOffer in 2018, after having this happen to me multiple times when buying homes to flip. With my deep experience in auctions and traditional real estate, I set out to build something better to marry the best of both worlds. That something better is SparkOffer. SparkOffer gives buyers and their agents a platform to make a digital offer on a home and have some transparency of what is happening in the process. In case you are wondering, I didn't get the home this past week. But, I did get an absolute first hand refresher in the brokenness. I'm thankful and grateful for it. I wrote down every day how the process made me feel. BTW - it wasn't good. Not because I did not get the house. It was every step of a 5 day journey with zero information about what was happening or going to happen. You go from hope after writing a solid offer to feeling like crap and at times just down right disgusted. The process is completely broken. What does my recent experience mean for SparkOffer's future? It means that I'm not only a 15 on a scale of 1 - 10 for motivation. I have also written the process down in a way I never have before. I'll translate the experience making SparkOffer from good to great. If you are selling a house, give SparkOffer a try. SparkOffer will give all parties a better more human and respectful experience.     James Kleimann - This was an excellent article filled with a lot of great data. I often discuss and have posted an example of a property we had on SparkOffer in 2022. The seller was the town of Mattapoisett in MA and they would only pay a 2% total commission. I handled the listing personally to test what would happen by listing a property in the MLS for a 1% buyer's agent commission. There are 3 major parts of the process that need to be considered. 1. Buyer access 2. Making an offer 3. Guidance/advice Over a two week period I held 5 open houses for 90 min each to provide easy access to buyers. Due to the town's equipment located in the building we did not offer a lockbox. Making an offer was presented for either a written sealed offer delivered to the town (which an agent would have had to write) or a buyer could make their own digital offer using SparkOffer. Buyers that needed guidance other than the information I could provide were encouraged to either use a buyer's agent or an attorney. (I don't believe in dual agency) Result: Agents did call me and told me they would not show the property to their client for a 1% fee. 30+ groups toured the property during the 5 open houses. 10 buyers made their own offers via SparkOffer. There was one agent, but their offer was for themselves and not on behalf of their client. No one made a physical offer on paper. The buyer that was selected with the highest and best offer hired an attorney to complete all of their diligence and contracts. In conclusion, agents did tell me 1% was not worth their time.     One of the central questions raised in the Sitzer/Burnett case is whether buyer agents "steer" 🐂 clients away from listings if the commission rate is below industry standard. A new study that looks at 265,000 listings across 34 metros concludes they absolutely do, as Will Robinson reported in this week's excellent edition of DataDigest. I think there's good reason to be skeptical about the study, but it's at minimum very interesting.
