Can AI help perfumes to be registered as trade marks in the UK or EU? With new technology, fragrances might overcome the Sieckmann criteria ( est 2002), which require non-traditional marks like scents to be represented in a way that is clear, precise, self-contained, durable, and objective. For a scent to qualify as a trade mark, it would need to demonstrate originality, like music or art. However, copyright law requires artistic elements to be separate from functional ones. Since perfumes are functional, achieving this separation is difficult—but if AI can capture only the sensory aspect, it may open new possibilities for protecting unique scents. Currently in the UK there is no straightforward IP protection for scents. With the above issues relating to trade marks and with copyright in the UK covering work that can visually or audibly be reproduced. What do you think?
