The Bayh-Dole Coalition recently sent a letter to the Senate Judiciary Committee expressing our support for three bills scheduled for review during the committee markup on November 14, 2024: S.2220, the Promoting and Respecting Economically Vital American Innovation Leadership (PREVAIL) Act; S.2140, the Patent Eligibility Restoration Act (PERA); and S.4713, the Inventor Diversity for Economic Advancement (IDEA) Act. If passed, they will strengthen our patent system, which is the foundation of the Bayh-Dole Act that has done so much to enhance U.S. innovation at the time we need it most. Our letter highlights the significance of these bills and their potential to advance America's technological and economic leadership. "The PREVAIL Act, PERA, and the IDEA Act would enable key reforms to bolster U.S. innovation and reinforce the patent protections that undergird the world-class technology transfer system established by the Bayh-Dole Act. To address the ongoing challenges facing inventors and safeguard the future of American innovation, we sincerely urge [legislators] to preserve the integrity of these acts in their current form during the upcoming committee mark-up session." "These three pieces of legislation would significantly enhance clarity within our current patent system, bolster patent protections for American innovators, and supply essential data to ensure we leverage our nation's full creative potential. Published in JAMA Health Forum, the study found: "The findings suggest that few drugs have solely march-in–eligible patents, so the overall effect of march-in on removing patent barriers to competition would be limited." READ: Kathy Ku, former executive director of the Stanford Office of Technology Licensing (OTL), recently published an article in The EdUp Experience talking about what she learned over the course of her exciting career in tech transfer. "Bayh-Dole allowed universities that received federal research funds to keep their intellectual property, a simple-sounding reform with a huge impact. We knew this gave us an enormous opportunity to turn academic innovations into real-world products -- not just to maximize profit but to benefit the public." "[T]here's no quick formula for success. The passage of Bayh-Dole was a crucial starting point, but ultimately the tech-transfer process requires resourcefulness, hard work, and a willingness to take chances." "In both my current and earlier roles, I've witnessed how central a tech transfer office can be to helping a university further its mission. Academics do tremendous work conducting basic science, discovering the fundamental physical realities of our world. But by transferring some of those discoveries to outside developers, universities can also do more. They can fund more research, and make sure that those breakthroughs go on to benefit society at large." READ: Doug Collins, who represented Georgia’s 9th Congressional District from 2013 to 2021 in the U.S. House of Representatives and is a former U.S. Senate candidate, recently published an op-ed in The Atlanta Journal-Constitution. He writes about how the Bayh-Dole Act has enabled historic growth and success in the state of Georgia -- and why the landmark law must be preserved. "Georgia is a powerful case study of Bayh-Dole’s success. Startups emerging from just one of our state’s universities, The University of Georgia, generate more than $500 million in annual economic impact, with more than 200 companies spinning out of UGA research. Georgia Institute of Technology features similar startup activity and licensing success stories." "...[R]esearchers’ discoveries might have perished in the lab without Bayh-Dole. Before the law, the government retained patent rights for any discovery it helped fund. Agencies rarely granted exclusive licenses for these patents, meaning private firms had little incentive to spend millions of dollars commercializing them. By 1980, fewer than 5% of more than 28,000 government-held patents had been licensed." "The Bayh-Dole Act has helped enable Georgia’s -- and the nation’s -- booming high-tech industries. If the Biden administration wants this success to continue, it must abandon its misguided effort."
