🌟 Upleveling Workplace Investigations🌟 ELS Managing Partner, Jamala S. McFadden, was thrilled to moderate a dynamic panel discussing workplace investigations at the National Bar Association's Annual Labor and Employment Section Conference. Workplace investigations are a crucial topic for employers and practitioners navigating the complexities of today's work environment. Joined by esteemed panelists Paul E. Garrison, Esq., Mediator/Arbitrator, JAMs; Shawn S. McGruder, Senior Associate General Counsel, Johns Hopkins; Maurice Q. Robinson, Assistant Director of Workforce Diversity and EO Compliance for the Port Authority of New York and New Jersey; and Janea J. Hawkins, Esq., Assistant General Counsel, Employment Law Freddie Mac, the discussion provided invaluable insights into executing effective and thorough investigations. Attendees gained practical strategies from both external and internal perspectives, equipping them with the tools needed to handle these often time-consuming and stressful processes with confidence. A big thank you to all our panelists for sharing their expertise and to everyone who participated! Together, we’re shaping a more informed approach to workplace investigations. 💼🔍 #WorkplaceInvestigations #EmploymentLaw #LegalDiversity

It's always interesting to compare the lawsuits filed by the #EEOC to what we see in our #litigation and #administrative charges practice day to day. These first #PWFA lawsuits will be important to watch.

👩⚖️ 📜 "The agency focused on enforcing the PWFA as an emerging issue. At the forefront of enforcement of the new law, the Commission’s lawsuits allege employers failed to provide reasonable accommodations to workers who were entitled to them and often discharged employees as a result." Yes, the EEOC plans to enforce the broad scope of the PWFA. Lots of ADA lawsuits here, too. I also note the 3 gender identity cases. Watch this space. #ADA, #retaliation, #PWFA #employmentlaw #EEOC #litigation #HRadvice

😐 Well this doesn't seem sustainable. 🤷♀️ "Driscoll said employers are now asking for skills not prioritized by the education system. When graduates subsequently fall short, companies are not investing in training either, Driscoll said." #Recruiters and #TalentAquisition friends - back me up here: The spin cycle of hire/fire/hire is time consuming, disruptive, and costly. And that's assuming you don't get an #EEOC charge or #lawsuit out of it. #Employers who aren't getting the skill sets they want from traditional college grads might want to ask whether the roles you're hiring for genuinely require a college degree. Perhaps not, if the degree isn't getting the right folks in the door. Regardless, genuine investment in your hires - including helping them navigate work culture and expectations - benefits employers in the long run (and helps avoid lawsuits later). #mentorship #employmentlaw #HRAdvice #GenZ #hiring

We are so grateful to be a part of and support such an amazing organization. Thank you to all of the amazing volunteers who aided in ensuring participants were able to have an informative and fun annual meeting, including our very own, Bethany Griffin. We look forward to the DDLC in March! #LegalSupplierDiversity #NAMWOLF #EmploymentLaw
We are filled with gratitude in reading all the wonderful things people are sharing about our latest Annual Meeting. However, we must give credit where credit is due and that is to the many volunteers that help make our meetings run as smoothly as possible: Susan Orona, Anna Ludwig, Vanessa Griffin, Chris Sisco, Bethany Griffin, Madeline Felipe and Vesatee Merkerson. Without the support of all of these wonderful women and their firms we would not be able to put on such a well-organized event. These women arrive early for registration, jump in wherever needed, problem solve, and do it all effortlessly. We truly cannot thank them enough for their time and energy.

Had an incredible time yesterday morning at the National Association of Minority & Women Owned Law Firms (NAMWOLF) 2024 Annual Conference! 😁 Alongside amazing attorneys Katie Connolly, Rachel S. Nicole Jagelbok, and me, we explored “Bridging Generational Divides: Navigating Pronouns, Dress Codes, Bathrooms, and Beyond,” moderated by Attorney Michael Kirkwood of The Employment Law Solutions. We had over 200 attorneys and staff in attendance—such an empowering experience! I’m truly grateful for the opportunity and honored to be invited back to serve alongside one of the sponsoring law firms, The Employment Law Solution. NAMWOLF’s mission is to promote diversity in the legal profession by fostering partnerships between minority and women-owned law firms and corporate and public entities. I’ll post a link in the comments to learn more about their impactful work. Thank you all for the opportunity to serve.
