  • Up to 85% of an organization’s data is Redundant, Obsolete, and Trivial (ROT). The final panel in Charlotte, sponsored by iCONECT, highlighted the growing risks and costs associated with this type of data. This unmanaged data introduces legal risks and costs, making data governance a crucial focus. Here’s what you need to know: Challenges of ROT Data Retention: Client Hesitation: ▫️ Many clients resist data deletion, fearing they "might need it," despite the financial and legal risks. Decentralized Data Ownership: ▫️ Numerous departments retain parts of the data, complicating holistic management.    The Role of Machine Learning & AI: Self-Contained LLMs: ▫️ Effective for security since they don’t learn from inputs, but this limits adaptability in AI-driven insights and decision-making.    Gaining Organizational Support for Cleanup: Motivating with Risks & Rewards: ▫️ Highlight the dangers of unmanaged ROT data while promoting benefits like reduced legal exposure and smoother workflows. Cross-Functional Advocates: ▫️ Identify data governance champions across divisions to create momentum and ensure buy-in. Proactive Data Retention Strategies: Document Prioritization Over Deletion: ▫️ Encourage a focus on identifying and keeping essential data rather than simply deleting ROT. Leveraging Data Migration: ▫️ Use migrations as an opportunity to "clean house" by selectively retaining only valuable information. Ongoing Audits: ▫️ Establish routine data audits, as comprehensive cleanup requires continuous effort. ROT data management isn’t an overnight fix; it’s an organizational mindset shift and a sustained effort toward proactive governance. Speakers: Jonathan Younie, iCONECT Judith Beall, Bank of America Adam Wehler, Robinson Bradshaw Alexander Lewis, Kuro Group #DataGovernance #LegalTech #ROTData #LegalConference

  • Meredith Perry (Relativity), Jim Calvert (Troutman Pepper eMerge LLC), and Kimberly Byrd (Kilpatrick Townsend & Stockton LLP) held a mock negotiation on Wednesday, where they discussed how to approach the integration of AI in their discovery. Jim and Kimberly played the roles of opposing counsels and came to an agreement about how each party would disclose the data they collected and the methods they used (AI in particular). They shared how GenAI is transforming e-Discovery, presenting Relativity's aiR for Review tool, which optimizes workflows by analyzing documents based on criteria set by subject matter experts (SMEs). The three-step process — Develop, Validate, and Run — enables thorough document review, achieving efficiency with metrics like recall, precision, and elusion. Key Takeaways: 1. Data Security: AI learns "weights," not content, addressing privacy concerns. 2. Process Efficiency: Pack & Stack model speeds analysis, maintaining review accuracy. • On Wednesday, we heard from Reveal's George Socha (and the godfather of EDRM) as he explored their AI e-discovery capabilities. He was accompanied by Natalie Carter of Duke Energy Corporation and Mike Gaudet of J.S. Held LLC. These three brilliant individuals gave us a rundown of the role AI can play in e-discovery and the ways to implement it. Here’s what they had to say: New Opportunities in eDiscovery ▫️ Introduction of AI models, including designer models that detect specific human behaviors. ▫️ Significant reduction in manual effort and time for legal professionals. Data Privacy Concerns Addressed ▫️ Even after a case concludes, sensitive data remains secure. ▫️ The AI model doesn't remember actual content but retains the "weight" of each aspect. Enhanced Workflow Efficiency ▫️ Accelerates investigative workflows. ▫️ Prioritizes document review for quicker insights. Expertly Curated Models ▫️ Tools are curated by industry experts for reliability. ▫️ "Pack & Stack" approach allows leveraging multiple models simultaneously. ▫️ Features are sorted by importance (weight). Widespread Adoption of GenAI ▫️ 79% of lawyers have adopted AI in some capacity. ▫️ Indicates a significant shift towards technological integration in law. Practical Uses in eDiscovery ▫️ Answering complex questions. ▫️ Identifying relevant documents swiftly. ▫️ Summarizing lengthy documents. ▫️ Drafting legal documents efficiently. AI and GenAI are transforming litigation by making processes more efficient while addressing concerns about data security. Exciting times ahead for legal tech! "Ask for permission first and you'll always get forgiveness if it goes badly." - Valerie Pennacchio  This is one of the many great points that our panelists made during yesterday’s session, “Developing a Legal Innovation Mindset” sponsored by Robinson Bradshaw What is Legal Innovation? ▫️ It's all about driving value by applying novel solutions to traditional challenges; push the status quo to achieve impactful business outcomes. • The cyber landscape is more dangerous than ever, and yesterday’s panel from J.S. Held LLC highlighted just how critical the threat has become. We heard from Mike Gaudet and Patrick A. W. of JS Held, Jason Byrnes (U.S. Secret Service), Patrick Hymas (Wells Fargo), and Matthew Warren as they dissected the latest facts. Here are some key takeaways: Soaring Costs: ▫️ The average cost of a data breach hit $4.48 million in 2023—a stark reminder of the financial stakes at play. Shadow Data Risks: ▫️35% of breaches involve shadow data—untracked or ungoverned data outside formal systems. It's a growing blind spot for organizations. PII is Prime Target: ▫️Nearly 50% of breaches involve personally identifiable information (PII) such as tax IDs, phone numbers, and home addresses. Ransomware Response Strategy: ▫️Victims who collaborate with law enforcement during a ransomware attack can reduce the breach cost by nearly $1 million. New and Evolving Cybercrime Tactics: ▫️Pig butchering scams: Fraudsters build fake relationships to coerce victims into bogus investments. ▫️Romance scams: Targeting vulnerable populations with emotional manipulation, especially the elderly. ▫️Crypto scams, business email compromises, and domain hijacking continue to surge. ▫️ATM Jackpotting is on the rise. Public-Private Partnerships: ▫️Stories from the Trenches: Spoofed Coinbase domains in India manipulated customers into providing their 2-factor authentication information before accessing their accounts and draining their crypto wallets ▫️Collaborative efforts between the private sector and government agencies resulted in the guilty party’s arrest when they attempted to enter the U.S. ▫️Read more about the case here: https://lnkd.in/dmVX6jcc Additional Considerations: ▫️Mandated Disclosures: SEC regulations require breach disclosures within 4 business days. ▫️Response Matters: Fast action is key—responding to a breach within 24 hours can significantly mitigate damage. ▫️Malicious Insider Threats: Insider attacks remain the most costly type of cyber attack. Cybercrime is evolving quickly, but partnerships and proactive measures are key to mitigating its impact. What an engaging panel! #LegalConference #LegalTech #Cybersecurity #DataBreach #CyberThreats
