Food for thought
Without naming names, we have a large space in our portfolio of leased, but vacant space. The tenant (“Corporate America”) pays rent every month without fail but does not occupy the premises. Occasionally, a manager or two may come in, but we mostly arrange access for their IT professionals. The premises have sat vacant since covid and we have been marketing the office space for rent on a sublet or direct basis, anything to help this tenant relieve their financial obligation. We finally have a prospect to take the whole space. The new deal would require a full work letter and professional fees valued at $80 per square foot. The new tenant would sign a 10-year lease and of course there is also a nice free-rent package that the new tenant was able to negotiate. We are moving forward with this transaction. Now, we are on the 5th round of lease comments, have a Surrender Agreement out with the tenant in possession (again Corporate-America), and are ready for executable drafts. Upon our follow-up with the Corporate-America tenant, we are now being told “They are not prepared to surrender the space, and would the Landlord consider a quick 5-year renewal, in as-is condition”? And just like that, our new deal is dead. As commercial real estate brokers, we get used to deals dying in the 11th hour, and never “count-our-chickens-before-they-hatch” but this deal has me thinking. While Corporate America in general has shied away from making long term real estate decisions, have they also decided its better to make no material decisions until it becomes clearer how the office landscape settles?
