This is a classic David and Goliath showdown. Our client found herself pitted against a massive insurance corporation. 2024 Atlantic Hurricane Season: Is Your Business Ready? Prepare Now, Protect Your Rights Later. With the official start of the 2024 Atlantic hurricane season on June 1st, the National Oceanic and Atmospheric Administration (NOAA) predicts an above-normal season with an 85% chance of increased activity. This forecast indicates a potential for 17 to 25 named storms, with 8 to 13 escalating to hurricanes, including 4 to 7 major hurricanes. These statistics underscore the importance of proactive preparation for Florida residents. Here's how you can safeguard your interests for your own property and property you manage: -         Review the property’s insurance policy. Be familiar with what it covers and what it doesn’t. You may always call us in addition to your insurance provider if you have questions. We’ve reviewed 1,000s of insurance policies and are very familiar with the language, coverages, and insurance loopholes. -         Document the property’s condition. Take photographs and videos of the outside and the inside of the property. You will likely need a record of the condition of the property prior to the storm should you need to file a claim. -         Compile a list of all your items inside of the property. Take pictures of them, too, and keep your receipts in a safe place while you’re at it. You’ll need to itemize them in a claim to make you or your business whole again should a hurricane hit your property and your belongings are damaged, destroyed, or displaced. They discussed the ways in which the insurance industry is manipulating the system to its advantage, including: * Grossly exaggerating the impacts of weather events on claims and profits. * Using adverse events to manipulate the state legislature into amending the Insurance Code in their favor. * Providing less coverage and more exclusions while simultaneously raising premiums. What did Brandon and Erik say? You might be surprised: “While weather events undeniably put pressure on insurers,” Arrow and Walker explained, “many of the charges of increased claims and decreased profits are grossly exaggerated by the insurance industry. Insurers actually use adverse events to their advantage in manipulating the state legislature to amend the Insurance Code to allow them to provide less coverage and more exclusions while raising premiums.” Further, Brandon and Erik note, "In the med-mal arena, for instance, health insurers claimed frivolous lawsuits had saddled doctors with unbearable premiums, prompting the legislature to make malpractice suits next to impossible to pursue in all but the most extreme cases. Yet, premiums did not decline because health insurance profit declines were the product of bad investments, not frivolous claims. Similarly, the homeowners insurance industry has convinced the legislature to allow them to exclude numerous harms, such as mold or pipe leaks lasting just a few weeks, based on inflated charges of excess claims."
