Did you know that fraudsters are impersonating absentee owners of real property (non-owner occupied/vacant land) to illegally sell real property? Sophisticated fraudsters are using the real property owner’s Social Security and driver’s license numbers in the transaction, as well as legitimate notary credentials, which may be applied without the notary’s knowledge. Some imposters are even changing the mailing address where the tax bill is sent PRIOR to selling the property out from the legitimate owner. Be on the lookout for red flags such as when a seller: 1) wants a quick sale; 2) wants a cash buyer; 3) the property is listed below market value; 4) is making excuses for note attending the signing 5) is difficult to reach via phone and only communicates by text and/or email 6) demands proceeds to be wired 7) wants to use their own notary 8) refuses or is unable to complete multi-factor authentication or identity verification. Check out this tip from Jen Perez, one of our escrow officers: “ Know your client. Know how your client wants to take title i.e. if they want it vested in a trust and there is a lender involved, most lenders don’t lend to a trust so have them check with their preferred lender early on in the transaction. Know your client’s current marital status & location they will be at the time of closing. If your buyer wants to take title as a married person as their separate estate there will still be documents for their spouse to sign. If your buyer/seller is married are both spouses in the same place for signing? If not let us know as early as possible so we can make arrangements to avoid any delays. Is there a pending divorce or separation currently? If your seller got married after buying the property their spouse will still have to sign off on the deed at closing as well.
