Thank you to the members of the CLOUT Network who participated in the annual meeting of CLOUT where we discussed this year's achievements and the next steps forward for the system. The CLOUT Network collects relevant case law and arbitral awards that reference UNCITRAL texts and prepares short summaries of those decisions to facilitate their understanding to foreign users. The CLOUT database provides free access to these summaries in the six official UN languages. In 2024, over 30,000 practitioners, students, judges, arbitrators have used the CLOUT database. The 8th Intersessional Meeting of UNCITRAL Working Group III (ISDS Reform) just kicked off in Chengdu, China on 24 October, with lively discussions centering on the possible establishment of an appellate mechanism in investor-state dispute settlement (ISDS). The UNCITRAL Colloquium on the Law of International Trade for a Greener Future is taking place today and tomorrow (23-24 October 2024) at the Vienna International Centre and online. The Colloquium will examine the relevance of UNCITRAL instruments to climate action, in particular the Model Law on Public Procurement, the United Nations Convention on Contracts for the International Sale of Goods (CISG), the Model Legislative Provisions on Public-Private Partnerships, and instruments on dispute settlement. Recommendations and conclusions are expected from the colloquium on whether and how additional texts could enhance the contribution made by UNCITRAL to the achievement of climate action goals set by the international community. The UNCITRAL secretariat was honored to join the INSOL International Seoul Seminar held on 7 October 2024 organized by INSOL International in association with the Insolvency Law Institution of Korea and Seoul Bankruptcy Court. Head of UNCITRAL RCAP Athita Komindr spoke on the ‘Cross-Border Chronicles’ panel to introduce UNCITRAL insolvency instruments and recent insolvency cases from the Case Law on UNCITRAL Texts (CLOUT) database. Other expert panelists were Judge Youngseok Kim of the Changwon District Court Tongyeong Branch and one of the Republic of Korea’s CLOUT National Correspondents, Justice Jonathan Harris of the High Court of Hong Kong, China, Ms. Shirly Cho and the panel chair, Mr. Scott Atkins. The "ESCAP-UNCITRAL Joint Webinar on strengthening legal frameworks for multimodal transport in Asia and the Pacific and beyond" took place on Wednesday, 16 October 2024. Over 50 participants attended the webinar, including government officials from United Nations ESCAP member States and representatives from interested organizations. Welcoming remarks were delivered by Ms. Azhar Jaimurzina, Chief of Section, Transport Division, ESCAP and Mr. José Angelo Estrella Faria, Principal Legal Officer and Head of Legislative Branch, UNCITRAL secretariat. During the webinar, Mr. Fedor Kormilitsyn, Economic Affairs Officer, Transport Division, UNESCAP presented a summary of ESCAP's work in the context of multimodal transport and introduced its new project to explore further solutions to enhance legal frameworks for multimodal transport for Asia and the Pacific, particularly in the context of operation of dry ports in the region and their integration into multimodal transport corridors. Ms. Tatyana Tymchenko, Consultant provided a summary of the guidelines for harminization of national laws on multimodal transport in Asia and the Pacific developed by the ESCAP secretariat. Ms. Yanying Li, Legal Officer, UNCITRAL secretariat, provided an update on the ongoing work of the secretariat on negotiable cargo documents and negotiable electronic cargo records. It was clarified that the new draft instrument would not regulate the rights, obligations and liabilities of the parties under transport contracts, which would still be governed by existing transport conventions. The project intends to build an additional layer and create a new document of title (negotiable cargo document) to facilitate financing, to increase flexibility in trade and most importantly, in a multimodal context, to provide a legal framework for the issuance and use of a single electronic record that would cover door-to-door transportation, thereby simplifying the documentation process and increase efficiency in operations. Ms. Elaine Ng, UNCITRAL Regional Centre for Asia and the Pacific provided an introduction to RCAP's activities and its role to raise awareness and promote the new instrument in Asia and the Pacific region after its adoption (expected in 2025).
