    “The current USPTO Director has said a lot of very positive things about wanting to promote individual and small business being assaulted by foreign competition and foreign misuse of our systems, so I had some hope that maybe they would look at this and see what was going on…. But they didn’t…. they just denied it.” Joel Rothman, Managing Partner SRip Law . . . Since Kathi Vidal became the Director of the U.S. Patent and Trademark Office (USPTO) in April 2022, there have been significant changes to the use of "director review” in patent law, specifically regarding decisions made by the Patent Trial and Appeal Board (PTAB). Director review allows the USPTO director to intervene and review PTAB decisions, which can include granting or denying institution of inter partes review (IPR) and final decisions invalidating or upholding patents. I looked up some of the key changes under Director Vidal and read that the most significant change she has made was clarification on Sotera/Fintiv guidelines. Fintiv has allowed many IPR petitions to be denied based on parallel district court proceedings which has ultimately helped inventors not have to fight at District Court and the PTAB at the same time. Vidal has recently introduced guidelines to limit such Fintiv denials, called the Sotera Stipulation. Wait.....why would she limit the FINTIV denials that are helping small inventors? How many of these Sotera Stipulations have been allowed? Perhaps that is topic for another post? Come to find this new approach, or some will call it “a highly effective tool for petitioners” has overall benefited PATENT CHALLENGERS, making it easier for IPR petitions to proceed. This might explain a little bit of Joel Rothmans anger and give some understanding why Kathi “just denied” the review in favoring the foreign entity. . . . 💚 This post goes to my good friend, Carrie Hafeman, inventor of “Find my Device”. 💚 Today, October 15th, Carrie is having to fight in both district court and now the Federal Circuit because Director Kathi Vidal, advocate of women, minorities, and children to innovate and patent their ideas, has granted Google and Microsoft as parties of interest for LG, a South Korean foreign entity, the Sotera stipulation, even though she was only weeks away from her district court trial. .     Our Keynote Speaker at our Second Annual US Inventor Conference was Joe Kiani, Founder of the public company Masimo. Joe was an independent inventor who became very successful. His most successful invention is the technology used in the clip that gets put on your finger in medical facilities around the world that non-invasively monitors your blood oxygen level. Here he is holding the US Inventor Beacon of Hope Trophy. Joe gave a very rousing talk about never giving up, no matter the adversity you face. And if you invent something today that has great value, you will face more adversity than has ever existed in the history of American innovation. A handful of huge corporations have lobbied into existence a massive change in our patent system. Unlike the past, you will rarely get your day in court with a jury and Due Process. You will be dragged into an unjust administrative court called the PTAB (Patent Trial and Appeal Board), where you will most likely have your patent invalidated. Joe Kiani and Masimo are embroiled in a patent infringement case with Apple that has been estimated to have cost them $100 million dollars so far. You and I must have effective patent rights that allow us to have our day in court, a fair court, where our attorneys can work on contingency. When the system is made fair again, the rampant theft of valuable inventions will stop. This is what US Inventor is fighting to achieve.     Last week over 125 inventors, business leaders, lawyers and advocates gathered for the 2nd annual US Inventor Conference. This was not your ordinary conference. This sampling of photos, in order as they are presented give a small taste of the three days. The group found unity and new friendship. The speakers brought inspiration and light.     I have a zillion things I want to share about the last few days I spent at the US Inventor 2nd annual conference. I'm going to start with this post and photo I took with Scott Sander. Below is a piece taken from an article in The Medium about Scott's story. It hits home for me and for thousands of small inventors who have lost everything because they never got a day in court to protect their life's work. . . . Steve Jobs himself declared: “If protection of intellectual property begins to disappear, creative companies will disappear, or never get started. But, there’s a simpler reason: It’s wrong to steal. It hurts other people. And it hurts your own character.” It is said that “justice delayed is justice denied.” The great frustration of my professional life has been the inability to tell my “Steve story.” I was always told that the only people that need to hear it would be a JURY. Apple’s success in keeping the battle with SightSound in the arcane forums of patent law at the Patent Trial and Appeals Board, and the Court of Appeals for the Federal Circuit, has kept my story from ever being told. Because of the masterful manipulations of lawyers, and the swinging pendulum of patent law, a jury may never have the chance to decide if SightSound should have been compensated for its innovations.
