Viktoria Morgan has over thirty years of experience in the law including extensive expertise in civil litigation. She represents clients in civil rights, discrimination, employment, and family law proceedings. She earned the Witkin Awards for outstanding academic achievements in Advanced Legal Writing, Remedies, and Professional Responsibilities while in law school. While earning her J.D. degree, she also earned Certificates of Specialization in Estate Planning, Family Law and Business Law. She interned in the Ventura County Superior Court Family Law Self Help Center as well as with private counsel practicing Federal Employment Law. Viktoria is a Southern California native. She graduated from high school at sixteen and received her Bachelor of Arts degree in Political Science with an Emphasis in International Relations from California State University at Long Beach. She was the fifth person in the State of California and the twenty-fifth in the Nation to achieve an Advanced Paralegal Certification in Family Law title prior to obtaining her law degree. She is a trained mediator through the Ventura Center for Dispute Resolution in cooperation with California State University Channel Islands.     In "In re N.J.", the Court of Appeal made a significant ruling that reversed the termination of a mother’s parental rights. The decision highlights key issues that resonate with many in juvenile dependency cases, including the failure to follow the Indian Child Welfare Act (ICWA) and the relative placement preference. The case involved the removal of a child from the mother at birth due to severe mental health and substance abuse concerns. Despite a maternal aunt consistently requesting placement, the Social Services Agency failed to prioritize and facilitate placement with the aunt, in direct violation of legal mandates. The agency delayed the evaluation of the aunt's home and did not set up meaningful visitation, ultimately denying the placement based on a stronger bond between the minor and foster caregiver. The Court of Appeal didn't hold back, stating: “This series of events—repeated violations of DCFS’s duty to follow the law and the court’s failure to enforce its own orders—resulted in a complete failure to honor the clear legislative mandate to give early and prompt priority to placement with family members.” Additionally, the court found several other critical issues, including the improper handling of ICWA inquiries and the failure to give proper notice to the mother’s conservator regarding the requirement to file an extraordinary writ. As a result, the court reversed the termination of parental rights, ordered a reassessment of reunification services, and directed proper consideration of the aunt’s placement request. The case was also remanded for a complete ICWA inquiry.     In a recent ruling, Okonowsky v. Garland (2024), the Ninth Circuit recognized that offsite social media activity can contribute to a hostile work environment. Lindsay Okonowsky, a former psychologist at a federal prison, discovered her co-worker’s Instagram page containing offensive and discriminatory posts, including derogatory references targeting her. Despite her complaints, the prison initially dismissed the issue, and the harassment continued. Rosamari Isong', the California Court of Appeal affirmed the trial court’s ruling, blocking Bijan Boutiques from voiding the property distribution in a marital dissolution judgment. Bijan sought to enforce a $327,000 debt owed by Rosamari Isong’s ex-husband, but the court found that "Family Code section 916" protected Isong’s Chino property from Bijan’s claim. This case sheds light on the intersection of Family Law and the Uniform Voidable Transactions Act (UVTA). The court ruled that since the division of property was judicially determined, not negotiated, the UVTA does not apply. Bijan’s claims of unjust enrichment were also denied under Family Code protections.
