TD, the ninth largest bank in the United States and second largest in Canada, pleaded guilty to money-laundering conspiracy, settling for $3.09 billion with U.S. authorities last week, without anyone at the bank being charged. Brian Klein, who talked with American Banker about the case noted, "A small business engaging in similar misconduct like TD Bank would likely see its key individuals prosecuted, but the sheer scale of a large institution often shields the individuals within it." "Large institutions, like big banks, can often absorb fines without major impact," said Klein. Waymaker Partner Brian Klein was interviewed this week on Bloomberg Law Podcast about the forthcoming federal corruption case against former Illinois House Speaker Michael Madigan. “The Supreme Court has been very interested in public corruption cases the last five to 10 years and in Snyder v. United States the Court narrowed the scope of public corruption by ruling that a bride by itself is not enough for a federal charge", said Klein.  He noted the United States Court of Appeals for the Seventh Circuit, which includes Illinois, holds that you need a “an ongoing relationship and a stream of payments to establish quid pro quo,” said Klein. Madigan, now 82 and the then longest serving state legislative leader in the United States, has been charged by federal prosecutors with racketeering, bribery and wire fraud. #fraud #whitecollarcrimes #supremecourt #politics #federalcourts

Today, the Daily Journal Corporation named Ryan G. Baker as one of California’s Top Trade Secrets Lawyers 2024. He was featured for his latest victory for IMD, Inc. in a penile implant case where a rival doctor violated an NDA to obtain trade secrets and then used that to secure two patents. The judge awarded $18 million in damages and  the patents were invalidated. Baker also defended Paradise Splash against various intellectual property claims, including trade secrets, and the settlement for a fraction of the damages sought was paid by insurance.
