Court filings in Oklahoma are now getting faster and easier thanks to a new e-filing system implemented in selected counties.
Great news! Oklahoma has implemented a new E-Filing system (finally!) for certain counties through a system called "OUCMS." More information is available here. For the initial release, registered users can electronically submit filings into existing civil, non-confidential district court cases in those particular counties. Here are two major points to be aware of: 1) The Terms of Use state that if you e-file a document in a particular case, you also agree to accept electronic service of documents (i.e., by email). The Terms of Use state: "By E-Filing any document via the OUCMS E-Filing Portal ... you agree to E-File and electronically serve all documents in that case only, and you agree to accept electronic service of documents delivered to the Designated Case-Specific email address on file in that case..." To register with OUCMS, you are required to check a box that says, "I acknowledge that my registration along with my initial electronic filing in a given case shall serve as my written authorization to accept electronic service pursuant to 12 O.S. § 2005." 2) E-filing with OUCMS does NOT automatically serve the other parties to the case with e-filed documents, and you are still required to independently serve the document. This is unlike the federal CM-ECF system and Texas's e-filing system, which automatically serves the other parties. When registering with OUCMS, you also have to check a box that says, "I acknowledge that I am responsible for service on other parties, and service will not be performed by the OUCMS." Winters & King is pleased to announce that Oklahoma Governor Kevin Stitt has appointed Attorney BC Lee to a position on the Oklahoma State University-Tulsa Board of Trustees. Lee’s appointment was recently confirmed by the Oklahoma Senate. The OSU-Tulsa Board of Trustees consists of nine members including 7 appointed for seven-year terms by the governor and approved by the Oklahoma Senate and 2 who also serve as members of the OSU/A&M Board of Regents. BC Lee is the Firm's estate planning and probate attorney. He has a broad legal, regulatory and financial background including a decade at a major regional bank as President, CEO, and Chairman. Lee earned his bachelor’s degree in business management from OSU and his Juris Doctorate from the University of Tulsa, the latter while attending college at night and working during the day. Congrats to BC Lee!

Were you aware that the Fair Labor Standards Act (FLSA) requires certain executive, administrative, and professional employees to be paid at least a minimum salary amount to be classified as exempt from the FLSA’s minimum wage and overtime requirements? In April 2024, the Department of Labor issued a final rule raising the minimum standard salary amount and the total annual compensation requirement for highly compensated employees for FLSA exemption. On Wednesday, I presented a CLE to the Oklahoma Bar Association's Women in Law section. We discussed major considerations for those that may want to integrate #genai into their legal practice, especially taking into account ethical and moral considerations. A special shoutout and thanks to Rhiannon K. Thoreson for the opportunity. Did you know that Comment 8 to #americanbarassociation's Model Rules of Professional Conduct Rule 1.1 (Maintaining Competence) requires lawyers to "keep abreast of ... the benefits and risks associated with relevant technology"? This would include the risks and benefits associated with the developing technology of #chatgpt and other generative AI. If you have an opportunity to attend a CLE on this topic, you will definitely find it interesting. Don't make headlines! If you choose to use GenAI to help with your legal research, read the cases- and, at minimum, make sure the cases exist!
