The city and the Legal Aid Society spent five months working on a legal compromise that would reshape one of the most unique and far-reaching homelessness policies in the country: the right-to-shelter rule, which obligates New York City to provide shelter to anyone in need. Friday’s settlement agreement establishes new rules for migrant adults who have arrived in the U.S. since March 2022. The new legal filing codifies the Adams administration’s current practice of limiting the initial shelter stay for migrant adults to 30 days — and gives city officials the right to deny shelter stay extensions to those who do not meet certain requirements. New York City’s net rental vacancy rate was 1.41% in 2023, the lowest vacancy rate since 1968 and a significant decline from 2021 when the rate was 4.54%, according to the New York City Department of Housing Preservation and Development’s Housing and Vacancy Survey. To keep up with demand, the Regional Plan Association projects New York City will need 473,000 more units of housing by 2032, but state level regulation limits the City’s ability to meet this need.
