Litigation Attorney

About The Role
An important member of the Legal team responsible for counseling national and regional business teams on statutory/regulatory obligations and providing expertise to further Oscar’s success. You will have litigation and regulatory experience and subject matter expertise with state and federal surprise billing arbitration processes. You will manage building legal strategies in all jurisdictions where Oscar has active independent dispute resolution (IDR) engagement.
You will report to the Managing, Sr. Counsel.

If you live within commutable distance to our New York City office (in Hudson Square), our Tempe office (off the 101 at University Dr), or our Los Angeles office (in Marina Del Rey), you will be expected to come into the office at least two days each week. Pay Transparency
The base pay for this role in the states of California, Connecticut, New Jersey, New York, and Washington is: $158,400 - 207,900 per year. The base pay for this role in all other locations is: $142,560 - 187,110 per year. You are also eligible for employee benefits, participation in Oscar's unlimited vacation program and annual performance bonuses.

Pay Transparency: Final offer amounts, within the base pay set forth above, are determined by factors including your relevant skills, education, and experience. Responsibilities
- Analyze and distill complex legal issues into easily understandable content so Oscar can move corporate goals forward.
- Be the national subject matter expert for one or more legal areas important to the business enterprise including interpretation of federal and state IDR requirements.
- Provide written and oral legal advocacy on behalf of Oscar’s interests in federal and state IDR matters.
- Provide subject matter expertise to further the development and continuous improvement of company and legal team processes.
- Manage defensive arbitration and litigation involving us and protect our rights in contract negotiations, disputes, settlements and litigation.
- Compliance with all applicable laws and regulations
- Other duties as assigned.
- J.D. from an ABA accredited law school
- Law license in good standing
- 6+ years of relevant experience at a top tier law firm, in-house counsel, insurance regulatory agency and/or legislative committee
- Familiarity with the No Surprises Act and state-based surprise billing arbitration statutes and regulations
- Strategic thinker with experience evaluating and determining legal course of action to meet our needs
- Trial, arbitration and negotiation experience.
- Experience with Oscar markets.
- Experience working with attorneys and internal stakeholders.
