- Post-mortem rights of publicity. Can someone have rights of publicity even after they're deceased? The answer is yes. In many states, the rights of publicity go beyond the life of the celebrity. In fact, many dead celebrities have very valuable estates because their rights continue to be licensed. Some well-known examples of such celebrities include Elvis, Marilyn Monroe, Prince, Michael Jackson, and Dr. Seuss. That's right, the estate of the deceased celebrity can license those rights for fees and they can and do enforce when somebody uses those rights of publicity without permission. If you plan to use a celebrity image, whether they're alive or not, be sure you get permission.
