- Preventing rights of publicity infringement. You can see that the right of publicity is pretty intuitive. It's pretty easy to understand. People have the right to protect the use of their name, their face, their persona and their voice. If you take video, you should get a model release. If you take photos of people, for example, for creating a website, brochure, promotional video, you should get a model release. If you're going to put somebody's name on something, you should get a release for that. Even if a celebrity has been photographed with your product, you can't use their image to show that they endorse the product without getting their permission. Also, it's pretty easy to buy a stock photo of a celebrity on websites like Getty Images. Can you use those? You can use the image if you paid for the license, but you may not use the image in a way that implies that the celebrity endorses your product or service.
