Few EMS cases have attracted the attention and controversy as the Elijah McClain case. While I've been interviewed for legal perspectives on the case by media outlets including the New York Times, Associated Press, USA Today, ABC News, the Denver Post and others, by far the most informed and insightful questions I've been asked have come from a journalist with the Sentinel, a local newspaper in Aurora, Colorado, the city where the tragedy occurred. His article is a must-read for anyone interested in this case, both for the impacts of the case in Aurora Fire Rescue, and for EMS providers nationwide. This article adeptly addresses several very legally and technically complicated issues, including: • The newly-blurred lines between civil and criminal liability for EMS practitioners; • Whether the time-tested principle of "implied consent" in emergency healthcare is still valid, and whether EMS practitioners will rely on it, in light of the guilty verdicts against two paramedics in this case; and • "Scope limiting" by paramedics who voluntarily reduced their scope of practice to the EMT level after the verdict. From the #clinicaltrial trenches: Mid-week investigator meetings. A mid-week investigator meeting is senseless. Most of us see patients. A few weeks’ notice is not enough time to reschedule patients – particularly when the wait list is more, a lot more, than a few months. And then there is staff. So long as they are seeing patients, they are earning. Now I have to pay for travel and time away. Worse, they will still have a few hours of training on the infernal portals. There we are, another big bump in fees if the silliness persists. #clinicalresearch #clinicaloperations #drugdevelopment

The tragic deaths of persons with severe agitation and delirium while being restrained by law enforcement has received well-deserved nationwide attention. Misguided legislation that sought to address this has occurred, notably in Colorado where legislators stepped into medical practice by effectively banning ketamine use in EMS. What was really the most important and correctible aspect of these events that could have obviated fatal outcomes? I believe it was the absence of defined transitions of responsibility between law enforcement and EMS as well as translational learning opportunities between those who keep us safe and those who provide medical care. In other words, when EMS is summoned to such a scene, the medical clock starts when the scene is "secure", the collaboration then begins. I am proud to have been involved in an effort among the National Association of EMS Physicians, International Association of Fire Chiefs and the International Association of Chiefs of Police to better define our opportunities for safely managing these events. This resulted in the publication in PEC of "Consensus Statement of the National Association of EMS Physicians, International Association of Fire Chiefs and International Association of Chiefs of Police: Best Practices of Collaboration Between Law Enforcement and EMS During Acute Behavioral Emergencies".
