Interstate travel plays a key role in expanding or restricting abortion access and has gained increased attention following the Dobbs v. Jackson decision. As the Office for Civil Rights (OCR) and Department of Health and Human Services (HHS) continue to monitor rulings and propose new guidelines regarding reproductive health, it's crucial to stay updated on what is impacting HIPAA compliance. Today, the Supreme Court decided unanimously to uphold access to and regulatory approval of a safe and effective prescription drug that is used, among other things, to perform first term abortions. Reality and sanity prevailed. In case you haven’t heard, there was a real danger in this case that not only would reproductive freedoms be sharply curtailed, but also the regulatory power of the FDA would be restricted or eliminated. If the lower court ruling had stood, these fever dreams of the most ardent Christian nationalists in the current Republican Party would have come true. All because the Trump Administration had appointed a single, massively unqualified, radical right federal judge to a small court in Texas where he was the only arbiter of whatever he called justice. Because of this case, the federal judiciary changed their policies in assigning judges, so that petitioners can no longer “judge shop” and bias the outcome with judges like this one. Because of this case, we have finally found some modicum of unanimity even on this fractured Supreme Court. But also, do not for one minute think that if Trump is president again and the current Republicans running win the Senate back, that he would not take the opportunity to appoint justices that make Kavanaugh look like RBG in comparison, and force a different decision next year. Sanity prevailed today. There is a very real danger it would not ever again, if the Republican Party as it currently stands wins big in November. Let this peek over the edge of the cliff motivate you into action. It’s time to get to work.
Today, the Supreme Court preserved access to abortion medication, throwing out legal challenges from those who would restrict access to reproductive health care. This is an important victory in the fight for women’s health. ¡La Lucha Sigue!

Being able to make decisions about your health is one of the most basic pillars of personhood. You create the dominion over your own body. In Idaho v. US, Idaho argues that a federal statute (whose acronym is EMTALA) put into place to prevent people from being thrown out of ERs and materially deteriorating because no one wants to treat them, just doesn’t count when it comes to pregnant women who are in the throes of a medical emergency that requires an abortion as life-saving care. Why? because Idaho’s near total abortion ban forbids it, until a woman has materially deteriorated enough that a group of non-doctors can decide whether or not she is sick enough to have an abortion. Or, the doctor, who is subject to criminal penalties and the loss of their livelihood for providing abortions, can use their “subjective judgment” and roll the dice and see, if, after the fact, the government agreed with that judgment. So, to recap: IDAHO: pregnant women having a pregnancy related health care emergency need to be staring at their death to get an abortion. GOVERNMENT: Hospitals that receive Medicare and Medicaid must provide care, including abortions, to people in health emergencies so they never have to unnecessarily stare at their death. States don’t get to ignore Federal law to take away people’s rights. We’ve seen how that works out and that’s why we have the 14A. And it was also about reproductive justice in 1868 too. Was so thrilled to be able to have Peggy Cooper Davis cited to that last point, as well as so many other beautiful minds on the question of reproductive justice and race. Idaho v. U.S will be argued on April 24. I hope you will listen to the arguments. I know we already know, but there are a lot of lives at stake. #EMTALA #personhoodisforpeople
📢 We filed an amicus brief with New York University School of Law's Reproductive Justice Clinic and If/When/How! Our brief argues that Idaho's abortion ban cannot be allowed to force pregnant people to lose their rights to emergency medical care to save “fetal life” under The Emergency Medical Treatment & Labor Act (EMTALA). EMTALA is a federal law giving anyone facing a medical emergency the right to stabilizing healthcare without exceptions—including abortions. Everyone experiencing a health emergency should be able to get the care they need without political interference.

This #ReproductiveJustice Tuesday, we are uplifting a documentary that brings attention to abortion access issues right here in Denver. Denver might seem like a champion of access for reproductive healthcare services. However, it's important to remember that laws allowing choice don't necessarily mean that abortion services are accessible. Denver already serves the surrounding state of Colorado where 30% of counties are classified as maternal care deserts. And since the overturning of Roe vs. Wade, we have seen a higher number of abortions in Denver due to pregnant people from anti-abortion states seeking services here, which strains available resources. Moreover, when it comes to healthcare access, Denver's care deserts are fed by problematic institutional practices that result in racism, poverty, and a lack of education and transportation access. The majority of people affected are pregnant people of color – who are also the main victims of the extremely high national maternal mortality rate. Watch this mind-opening documentary written and directed by Felicity Daleccio titled "ACCESS: Reproductive Care Deserts in The Denver Metro Area" to learn more.
