How can we support former climate jury or assembly participants to build momentum for change? The main aim of a citizens' jury or assembly is to convene ordinary people with diverse experiences and perspectives to write recommendations on what needs to happen. As demographically representative groups, juries or assemblies can provide legitimacy when making decisions on contentious issues. However, the journey from writing recommendations to implementing them in policy is never straightforward. Policy-making processes involve diverse actors and interest groups who will need to be brought onboard. Strict funding rules can lead to inaction or slow progress. Politics is also unpredictable, with elections every few years. We believe that the diversity of experiences and perspectives is one of the greatest strengths of a citizens' jury or assembly, which can be a potent force for change beyond the initial recommendation writing process. With this in mind, we supported former participants of the Blackburn with Darwen People's Jury on the Climate Change Crisis to push for change based on the recommendations they produced in late 2022. Over 12 months, we supported former jury members to present their recommendations to stakeholders, hold the council to account, meet their MPs, and set up a climate café, amongst other things. When political polarization is high, industries can be also politicized. Thanks to Columbia Business School Research in Brief for featuring our paper on how #PoliticalPolarization impacts #BusinessRegulation. With Yuni W., I find that the greater the political polarization of a state, the more local restrictions the U.S. hydraulic fracturing (fracking) industry face in that state. Players in the industry thus seek interventions by conservative elites at the state government level. The dominance of conservative state legislators and the presence of affiliates of the right-leaning American Legislative Exchange Council (ALEC) are bound to strengthen the industry’s lobbying efforts in that state. These, in turn, increase the likelihood of the enactment of state preemption laws that nullify local restrictions. The Green's biggest dilemma today is how to turn ideology into reality, or rather how to understand that reality trumps ideology. The big losers in Brussels’ local election - and of the previous EU elections - were, as expected, the Greens. I say “expected,” as no matter how much people care about the environment, most won’t agree to a reduction in their perceived quality of life — or to pay more for it. “Ah, but we’re heading for the abyss,” they say. And while that’s true, it doesn’t change reality. Everybody wants to save the planet (hopefully), but most aren’t willing to sacrifice themselves while the rich get richer and keep enjoying all the benefits. It’s time for a reality check within the Green movement: Winning elections isn’t just about having the right message, it’s about having a message that resonates with people’s daily concerns. We have focused on state and local regulation in the climate space in the past two years and last week, we got the last and best word on whether New York's Green Amendment created private rights of action. In the blog linked below, Samuel Rasche and I break down a recent NY intermediate appellate decision in the Fresh Air for the Eastside case, which evaluated whether an NGO can use the Green Amendment to sue private or public actors. Short answer, no. What's next? Probably a trip to New York's highest court for this case. At least theoretically, we could see action in NY's legislature to give the Green Amendment more teeth.
