The federal permitting process is broken. And while I'm skeptical Congress can push through the Energy Permitting Reform Act of 2024 (S. 4753), I'm still crossing my fingers they find a way to make it happen. The bill sailed out of committee on a 15-4 bipartisan vote, but there's a long road ahead with everyone jockeying for their own additions, the White House pretty mum, and the bill facing an uncertain future in the House even if it clears the Senate. Maybe it has the best chance of passing in the lame duck. The proposed law has something for everyone, including: -150-day statute of limitation for judicial review of agency action granting/denying authorization for energy/mineral projects. -Mandated increases to federal onshore and offshore energy leasing and permitting and streamlines permitting process. -Streamline and accelerating permitting for interstate electric transmission lines. -90-day deadline for approval of all pending/future LNG export facilities once FERC publishes final environmental review document. -Favorable hydropower reforms, including 4-year extension of time to commence construction.

An excellent one-pager on the Manchin-Barrasso Permitting Reform Act of 2024 as it applies to LNG "Liquefied Natural Gas Exports: Sets a 90-day deadline for the Secretary of Energy to grant or deny LNG export applications following environmental reviews, with applications deemed approved if the Secretary fails to meet the deadline. Ensures fact-based decision-making by requiring the Secretary to base decisions on DOE’s existing LNG economic and emissions studies, unless and until new studies are completed.
