Last week, the Federal Trade Commission published a pretty important update in a blog post regarding consumer facing applications in the FTC Tech Summit on AI. One of the striking details is that the FTC may consider "quietly" amending terms of serve agreements to address AI processing may be unfair or deceptive. In other words, it may be unfair or deceptive for companies to implement data practices that include sharing consumer data with third parties or using that data for AI training and then inform consumers of this change through retroactive amendments to the ToS or Privacy Policy. As is always the case, transparency is the best approach. Before utilizing data for AI processing or training, make sure you have user consent via a method that is explicit and does not hide the ball. The U.S. Federal Trade Commission (FTC) announced a final rule to tackle several types of fake reviews and prohibit marketers from using deceptive practices, such as AI-generated reviews, censoring honest negative reviews, and compensating third parties for positive reviews. The FTC’s new rule has been a long time coming. It aims to improve the often untrustworthy online review system and — hopefully — make it easier for people to find reliable reviews.
