Buildings and bridges: following on from my post on the world of patents (Non-SEPs and SEPs) in the context of building facilities infrastructure - https://lnkd.in/eterz76m made me think a bit more about the SEP bridge connection. Bridges are enabling facilities based on recognized standards (most of the time) on interoperability (just as SEPs are in the IP technology connecting sense). The main differences between a physical bridge and an SEP bridge is that a physical bridge is less likely to be SEP patent related (although this could be the case if there are electronic communications issues to be addressed related to the bridge). However, the similarities related to standards, regulations and purpose of interoperability, support the idea of achieving ease of use and a seamless operation of the actors involved - such that most of the time we take all this for granted. #standardessentialpatents #seps #interoperability #standards

👀 UPC’s must-sees : UPC_CFI_9/2023, 25 May 2024, Huawei v Netgear 📝 Rule 190 (order to produce evidence), Rule 262A (protection of confidential information): Please order me. 🥥 In a nutshell: ◾ The Court can order a party to produce evidence it has in possession but it cannot provide due to another court’s order. ◾ The court can order protective measures to protect legitimate confidential interests of the parties and third parties. ◾ No general permission to use the evidence in other proceedings can be given. Orders can only be made on a case-by-case basis. 📸 The facts: ◾ The claimant sued the defendants for infringement of a standard essential patent. ◾ The defendants claimed exhaustion of rights based on a licence agreement between the claimant and the defendants supplier. ◾ The licence agreement was evidence in proceedings in the USA. ◾ A request to the US court for production of the licence agreement in the UPC was denied. ◾ The defendants requests the UPC to order production of the licence agreement. ⚖ Solution: ◾ The defendants not being able to voluntarily produce the licence agreement, it is fair to order its production to facilitate the debates. ◾ Legitimate confidentiality interests of the parties must be protected and a confidentiality club is set up. ◾ The order is issued on a case-by-case basis and there is not general authorization to use the licence agreement in other proceedings. #ifyoudontknownowyouknow #UPC #JUB #unifiedpatentcourt #juridictionunifieedubrevet
