This LA Times article describes the impact of a California court ruling banning the use of certain identifiers, for example date of birth when searching court records for background checks. The ruling was made following concerns by a group that use of such records discriminates against ex-offenders. The net result, seems to be that if you have a common name, a pre-employment background check may take months and months, or be returned by the checking agency as impossible to perform - I guess that could mean no job. In the ant-fraud and HR field, we all preach the importance of proper vetting of potential employees, could we see similar happen here in the UK, albeit access to records is far more controlled and allows for self-checking. #data #recruitment #vetting #employmentchecks #data #criminalrecords #calfornia https://lnkd.in/eysGHn4U

A research team analyzed criminal records for 101 people in New Jersey, comparing official state reports of arrests, criminal charges and case depositions with two sources of private-sector background checks (one regulated and one unregulated by federal law), as well as interviews with the participants. An update from the background screening industry: Last month, the Los Angeles Superior Court announced the removal of birth dates from its public index. Only defendants or their attorneys can now verify ID with a clerk, leaving others unable to do so. These new regulations present a significant obstacle in completing criminal searches for applicants with potential records in Los Angeles. Unfortunately, there's currently no straightforward solution for dealing with common names. Even with an applicant's middle name to filter through records, challenges may arise in verifying the correct individual. This poses a particularly challenging situation for applicants with clean records who could be mistakenly associated with defendants listed in the LA criminal index due to name similarities. In response to these obstacles, we're actively exploring innovative solutions to address the complexities posed by common names. Despite these challenges, our commitment to providing timely and accurate background check services to our clients remains unwavering.
