Pay attention! https://lnkd.in/g_kRcywx This election is the last one to pretend to be decided by votes of the people unless control is taken from the Republican Influenced Corrupt Organizations (RICO) under the coordination of the Federalist Secret Society and Heritage Society This election must focus like a laser beam on reigning in the RICO led Gang of 6 on the Supreme Court and undoing its enabling the Presidency to be the top Criminal of The United States (COTUS). Repeat of Jan 6th as upside down flag day has been boldly called out by the July 1st edict. Boldly is not just a code word. Defeat MAGA or else, and then take back the Court through expansion. Let us then enter back into mutually agreed reform consistent with both historic and modern political values. Or 248 years of experimenting in quasi-democratic government ends by this time next year.

With the end of the semester now complete, I would like to highlight our final project for my Constitutional History class. The task of our final paper was to characterize and explain two jurisprudential approaches, “textualism/originalism” and the “living constitution” approach using the perspectives from Attorney General Edwin Meese and Justice William Brennan respectively. Our task was to also pick Supreme Court opinions that are representative of each approach and analyze them, and in doing so pick an approach which we find more compelling.

Here is my recent piece at the Brennan Center for Justice’s State Court report discussing how sometimes state Supreme courts lead, and the U.S. Supreme Court follows. This federalization dimension in constitutional interpretation is increasingly gaining followers and adherents, but we should also understand, recognize and appreciate the rich history and tradition of the practice when applying this fascinating interpretive tool.

I wish I could spend my day shouting 'Lawyers have a special duty to take action to preserve and enhance our democracy' from the rooftops. Lawyers hold a unique volume of wealth and power in our society. We need to be thinking hard about where and how to use that power. We need to be honest and direct when we see politicians advancing policies that are harmful to democracy, women's bodies, queer existence, the realities of a growing housing crisis, &c&c. When presented with conspiratorial thinking and talking points designed to transform latent hate and confusion into anti-democratic political power, we need to be willing to stand up and say, this is wrong, this is incorrect. And even more than saying this is wrong, this is incorrect, we need to take the time to learn how to bridge the gaps between our mindsets and these conspiratorial stances. It may not be as easy as saying it is wrong, it may be a much more patient process, it may require some serious lateral thinking, but we still must commit ourselves to overcoming and communicating across these barriers.
