Today, the Biden Administration announced new policies that would allow the government to rapidly expel asylum-seekers who cross between ports of entry, without individualized review, if border encounters meet a certain threshold. The new policy relies on the Immigration and Nationality Act sections 212(f) and 215(a), laws the Trump Administration used to implement the discriminatory Executive Order 13769, also known as the #MuslimBan

Happy #ImmigrationReviewPodcastMonday! Well, the Senate's Bill is out, and appears to envision funneling more and more asylum adjudication and authority to border officers in lieu of Immigration Judges. How will border officers account for case law differences among the circuits and BIA? Such as, for example, this recent quote from the First Circuit regarding the nexus standard for family-based and other asylum claims. Then again, the First Circuit relies on the immigration statute itself, which always wins, no? : ) Kurzban Kurzban Tetzeli and Pratt P.A.

The San Antonio city council is discussing how the city can fund and support the Migrant Center that serves illegal aliens. By providing taxpayer financial support to the Migrant Center, the city is facilitating illegal immigration and ignoring immigration laws. The city is also encouraging illegal aliens to depend on cartels and criminal gangs to cross the border. Taxpayers will be paying federal and local taxes to support the illegal immigration.San Antonio should not encourage and support illegal immigration. Illegal immigration is ILLEGAL and elected officials should not use taxpayer funds to break the law.Taxpayer money should serve citizens only. SA citizens and taxpayers must say NO to funding any part of illegal immigration. Otherwise, what’s the point of being a lawful citizen if an illegal alien gets the same benefits and rights? https://lnkd.in/gHHrSN3F

Immigration Attorney at Vorys | Ohio AILA Pro Bono Liaison | Believer in due process and access to critical legal services
We should continue to see these types of rulings unless courts start to radically re-interpret federal authority in immigration. Nevertheless, the fate of these state laws aggressively challenging federal immigration authority will be something to keep an eye on given their spread across the country and the political climate around immigration these days.

🇺🇸👏 The Supreme Court has once again delayed Texas' Senate Bill 4, which would grant state authorities the power to arrest and deport migrants, marking a setback for Texas Republicans' efforts to enhance state-level immigration enforcement. Justice Samuel Alito extended the stay indefinitely, amid legal challenges asserting the law's conflict with federal immigration powers and potential constitutional violations. Texas Republicans argue the law is necessary due to increased border crossings, but critics deem it unconstitutional and detrimental to foreign relations. The decision comes as Texas seeks to challenge federal immigration authority, highlighting ongoing tensions between state and federal jurisdictions over immigration enforcement. 🌐 Learn more on the following link: https://ow.ly/W1aM50QWaEM #PowersLawGroup #Immigration #SB4 #ImmigrationAttorney #Border #Texas

President Joe Biden plans to sign an executive order to shut down asylum requests at the U.S.-Mexico border once daily encounters average 2,500. The border will reopen for asylum only when encounters drop to 1,500. The order, Biden's most aggressive move on immigration, could take immediate effect due to current high crossing rates. The policy will use Section 212(f) of the Immigration and Nationality Act, similar to Trump’s approach. While the White House aims to manage border encounters, it faces legal challenges and opposition from advocacy groups and some Democrats. Biden will announce the order with border mayors present. 🇺🇸 #PowersLawGroup #usimmigration #immigrationlawyer #unitedstates #immigration #asylum #usa

Although it is a border bill, the Senate deal does include 18,000 extra Employment-based green cards each year for next 5 years. Kids of H-1B holders would not age out if they spent at least 8 years in H-4 status before turning 21. H-4 employment authorization incident to status for spouse and kids. Is it perfect? No. But it is progress for high skilled immigrants waiting for green cards due to per-country caps. #ImmigrationReform #GreenCardBacklog #H1BVisa #EmploymentBasedImmigration #HighSkilledImmigrants #H4EAD #SenateDeal #ImmigrationPolicy #TechImmigration #USImmigrationReform
