OIG Takes Its MA Fraud Fight to the Patient: Misstates a Part of the RA Rules Yesterday, OIG released a public video directed to #Medicare Advantage and #Medicaid managed care patients. It’s a clear shot across the bow, looking for patients to help identify fraud as part of the government’s on-going False Claims Act litigation against plans. The video, however, misstates a crucial element of the government’s own risk adjustment diagnosis rules and may, inadvertently, discourage some patients from participating in screenings and receiving appropriate treatment. Taking a Swing at Risk Adjustment: The video uses tough language. It refers to risk adjustment fraud as the “well known concern” that plans use RA to “game” reimbursement by “overstat[ing] how sick their members are”. The video warns patients that they may be offered “free health risk assessments” that are designed to “make you appear sicker” than is the case or “diagnosis you with conditions you don’t have or have not received treatment for”. A Misstatement: That part suggesting it’s wrong to document a diagnosis that the patient hasn’t (at least yet) received treatment for is not correct under the government’s own rules. As the Manual states, the purpose of RA is to “allow[] CMS to pay plans for the RISK of the beneficiaries they enroll”, whether that risk materializes or not. “Risk scores,” CMS states, “measure individual beneficiaries' relative RISK and … are used to adjust payments for each beneficiary's EXPECTED expenditures”, not just actual costs. Risking Patient Harm: The video also runs the risk of harming patients by making them suspicious of and resistant to screening assessments. If a risk assessment identifies a new condition not previously identified, that can represent an enormously important clinical benefit of the assessment. Based on this video, there is a risk that a patient with a newly identified diagnosis may resist both that diagnosis and the medically necessary treatment to address it.
