ITALIANITÀ. The anonymous artist and activist Laika recently dedicated her last mural artwork to the Italian-born volleyball player and gold medalist at the Paris Olympics 2024, Paola Egonu. A few hours later the work was brutally vandalized and altered in the natural black colour of Paola’s skin, in a clear and brutal racism episode. CAN MURALS BE CONSIDERED AN ART PRODUCT? A debated topic from a legal point of view for years. How can the authorship of a work that was created, by definition, as a public creative product be recognized and protected? 1. According to Italian arts law, even a minimum degree of creativity is sufficient to obtain the “protection for the urban work of art, which, provided it is unique in its kind and a singular expression of the author's personality, is protected "from the moment of his creation." 2. As regards the author, whether anonymous or known, art.20 of the L.d.A. provides for "the moral right of the artist to oppose any mutilation, deformation or other modification, and any act detrimental to the work itself". The violation of this right also applies to "substantial or formal modifications that alter the narrative coherence, the meaning of the message or artistic value". The problem that arises when faced with works of an urban nature and which sometimes seems to have unclear boundaries concerns the relationship between artistic expression and the right to private property, i.e. the possible violation n by the artist of the ownership of a wall and of someone's else surface. In this case, the doctrine that has expressed itself on this debate considers the right of property to prevail over the freedom of art which is not essentially forced to use the private property of third parties. And what do you think? We are all familiar with the cliché of a struggling artist…but apparently the African fine art market is booming!! It was valued at over $1.8 billion according to the 2023 African Wealth Report. This includes the value of art sold by top African-born artists including Ghana’s #ElAnatsui and #AmoakoBoafo. But are African lawyers capitalizing on this opportunity? IP lawyers, for example, can play key roles in the success of artists and their agents, galleries, art fairs, fashion designers, photographers and other art-related businesses. They can help with copyright protection, drafting contracts for art sales, and navigating complex issues like intellectual property rights. Even if clients aren't ready for your legal services today, providing valuable information can establish you as a trusted advisor for their future needs. #ArtLawyers #BusinessDevelopment #LegalPractice #IPLaw #AFCFTA #AfricanArt Are you ready to unleash your creativity and tap into this lucrative market?? I'm talking to us, the undiscovered artists - just remember, even if your painting skills are more 'finger blotches' than 'fine art,' there's still plenty of room in the market for a masterpiece... or at least a good time.

Provenance is the documented history of ownership for a piece of art, and it plays a crucial role in the art market. Why is it so important? For one, it ensures the artwork's authenticity and protects against legal disputes. Additionally, a strong provenance can significantly enhance the value of a piece, especially if it has been owned by prestigious collectors or displayed in renowned exhibitions. As a collector, it's essential to seek detailed provenance before acquiring any artwork. An experienced art advisor can verify an artwork's provenance and help you navigate potential pitfalls, ensuring your investment is secure. Understanding provenance is key to making informed and valuable art investments. #ArtProvenance #ArtCollecting #ArtInvestment #ArtAdvisor #Authenticity

Orissa High Court Upheld ASI's 2017 Guidelines for Guides and Photographers operating at monuments under its protection including UNESCO recognised Konark Sun Temple. The court dismissed the writ petitions filed by 154 photographers and guides from the Sun Temple, and affirmed the 2017 guidelines, which mandate a minimum matriculation qualification, along with a mandatory written examination and interview for guides and photographers at the Konark Sun Temple. The petitioners argued that it adversely impacted their livelihoods and violated their rights under Article 19(1)(g) of the Constitution. The Court emphasized that fundamental rights are subject to reasonable restrictions. These measures aim to promote regulated and responsible practices while safeguarding India's cultural heritage. During the recent Mexican Folk Art Fair, organized by UNESCO in Xcaret, artisans and experts emphasized the urgent need to protect Mexican folk art from over-commercialization and plagiarism. Iconic cultural creations such as traditional textiles and indigenous art are integral to Mexico's cultural heritage and require robust intellectual property protection. UNESCO and creators highlighted the importance of safeguarding not only the products but also the cultural significance and processes behind them. Tools such as collective marks and geographical indications are essential in helping artisans preserve their creations and protect them from improper exploitation. At OLIVARES, as intellectual property experts, we support creators and communities in defending their cultural rights and protecting Mexican folk art. Our commitment is to offer comprehensive legal solutions that ensure the preservation of the country's artistic and cultural legacy. Learn more about how we can help protect your creations. Leave a comment down below 👇 ☺️ #arte #artvideo #artvideos #artvidéo #alletto #contemporaryartist #contemporaryartwork #artcollector #artcollection #videos #artistsupportartists #artsharing #visitgalleries #arttravel In this essay, an earlier version of which was given as the Daphne Mayo Lecture at the University of Queensland on October 8, 2014, Thomas Elsaesser examines the increasingly strategic role played by art spaces in the preservation and promotion of a certain idea of “cinema”. He argues that museums and galleries have been staking their claim to be the guardians of cinema as cultural memory and the patrons of moving image installations, leading to new alliances between filmmakers, curators and major institutions that have favoured media-archaeological perspectives on “cinema after film”, thereby giving the various kinds of obsolescence their special status as a gesture of both recovery and resistance. It will not have escaped anyone’s attention that the moving image – in the form of either video installations, monitors or black box film projections – has made a dramatic entry into the contemporary art scene. Suddenly screen and projection, motion and sound are everywhere, when previously hushed silence and the stillness of immersive contemplation reigned supreme in the temples of art we call museums. Some reasons are internal to the development of modern art practice, if one accepts that for many of today’s artists, a digital camera and a computer are as much primary tools of the trade as a paintbrush and canvas, or bronze and stone were a hundred years ago. Other reasons are more conjunctural, and in what follows, it is the latter I want to attend to. The Loop of Belatedness: Cinema After Film in the Contemporary Art Gallery Thomas Elsaesser
