Over the past two years, the Ukrainian IP sphere has undergone significant changes that have affected the judicial protection of intellectual property rights. This applies to both legislative and institutional changes. The introduction of martial law, the status of a candidate for membership in the European Union, as well as other key events, were reflected in court decisions. As EU law scholars, we often accept certain aspects of the EU legal system as a given—that the EU has its own Court of Justice, that there are Advocates General but no dissenting opinions, that individual applicants have limited standing to challenge EU acts, that the Commission has broad discretion in infringement procedures, and that preliminary rulings are key to obtaining judicial review of national law. But do we ever stop to ask why the EU system of judicial protection is set up like this?
