San Francisco: Delta Air Lines CEO Ed Bastian said the massive IT outage, earlier this month, cost the company $500 million. He said the figure included not just lost revenue but "the tens of millions of dollars per day in compensation and hotels" in five days, a news agency reported. This week, media reported that Delta Airlines is exploring claims for damages against Crowdstrike. An interaction between a Crowdstrike IT tool and Microsoft operating systems had apparently caused Delta systems outages and flight disruptions. Historically public companies have hesitated to invite discovery into their internal matters in public lawsuits. But attitudes are slowly shifting, particularly in these types of cases where potential damages are high—$500 million here, per Delta’s CEO—and taking a public matter seriously might positively impact investor relations. These cases’ high upside makes them strong candidates for either contingency fees or hybrid arrangements, with reduced hourly rates and a success fee. Many large firms shy away from contingency work. Kelley Drye maintains flexibility to take such cases where they make sense for both the client and the firm. It is exciting to be working with a firm that has positioned itself well in the market.

Good Point Erika! Aircraft manufactures (Boeing, Airbus) design and build the aircraft. They also provide all of the approved technical publications required as well as the training needed to operate and maintain the aircraft in an airworthy condition. After that it's on the owner/operators to continue that trend. The operators have a responsibility to the FAA and the public they serve to follow the law and the program guidelines to ensure aircraft take off from one location and land safely at the other end in the same condition. That means participating in the periodic maintenance cycle. Take the aircraft out of service to perform maintenance when it's due. Do not deviate from the scheduled inspection times or dates. Do the maintenance right when it's due and follow your tech data to letter and teach your people to do the same. As to the slides, maybe these panels need to be inspected at a more frequent interval. After all opening and closing the door, arming and de-arming the door and slides, and just normal operations beat the "STUFF" out of these doors. It might take a bit more time away from operations, but it might serve to make them last longer and prevent an unintentional separation from the aircraft. Just a thought.
