Earlier today, HHS-OIG and the Justice Department announced a national enforcement action which may have resulted in over $2.75 BILLION in false claims. Here's my thoughts: - Despite recent emphasis on combatting increasingly sophisticated health care fraud schemes, many of the schemes described are surprisingly unsophisticated (e.g., billing for services not rendered, kickback conduct, paying for referrals, etc.). Today's enforcement action demonstrates that the government is still paying attention to these "boring" schemes. - The following areas can expect continued (or additional) scrutiny: amniotic wound grafts, COVID-19 testing, prescription and distribution of opioids and stimulants, and substance abuse treatment, telehealth, and laboratory claims, among others. While most providers would not likely be involved in schemes of this depth and breadth, it's also a reminder that the government has a wide reach, vast resources, and a steadfast commitment to protecting Federal health care programs.

Ruthia He, the founder and CEO of Done Global Inc., was arrested in Los Angeles and will make her initial appearance at 1:30 p.m. PDT/4:30 p.m. EDT in Los Angeles. David Brody, the clinical president of Done Health P.C. (collectively, Done), was arrested in San Rafael, California, and will make his initial appearance at 10:30 a.m. PDT/1:30 p.m. EDT in San Francisco, California. “As alleged, these defendants exploited the COVID-19 pandemic to develop and carry out a $100 million scheme to defraud taxpayers and provide easy access to Adderall and other stimulants for no legitimate medical purpose,” said Attorney General Merrick B. On June 13, 2024, the Justice Department announced arrests in what it called the nation’s first criminal case against digital health company executives over allegations that those executives caused illegal prescriptions for controlled substances to be ordered by way of telehealth visits.While the Justice Department has previously brought charges in telehealth cases involving things like orthotic braces or genetic testing, a case against digital health executives involving telehealth-prescribed controlled substances is a first.According to the Justice Department, two executives of a company called Done Global Inc. caused their company to provide prescriptions for controlled substances like Adderall through a telehealth system that the Justice Department claims to be illegal. That system involved patients subscribing to Done in exchange for access to controlled substances. Once subscribed, Done allegedly found ways to generate wrongful orders for controlled substances for those subscribers. According to the Justice Department, Done’s prescribers were not given full information about patients and were given a short amount of time to evaluate patients’ needs for controlled substances. Done then allegedly discouraged follow-up care for patients by restricting compensation to prescribing physicians for that treatment. That, combined with a feature that allowed Done subscribers to obtain automatic refills of their orders, is alleged to have resulted in healthcare fraud, according to the Justice Department.

Here’s more. ⬇️ Bloomberg’s article on acting US Attorney Joshua Levy reveals the Boston office is handling more than 20 new false claims whistleblower cases that were filed last year. Levy also says they’re watching: 🔍 Expensive rare disease medicines 🔍 Kickback theories involving genetic testing 🔍 Electronic health records This follows the office’s December Ultragenyx settlement, which left many of us scratching our heads. AND it coincides with yesterday’s news that BioMarin is cooperating with a probe into two of its #genetictesting programs. Up-front diagnostics can be essential for #patients to qualify for rare disease therapies. Yet payers can deny the test that proves – or disproves – the indication. And while these programs fill an important need, it seems like a good time for companies to take stock of their structure and execution. This hits home on a personal level. As an ex-Truepill executive AND the current owner of a telemedicine platform, reading the latest news about “Done” makes me deeply troubled. I’m not a doctor or a pharmacist. So instead, I set out to fix problems in our healthcare system the only way I know how: by creating amazing technology that helps doctors and patients connect over the internet. But here’s the point: I’ve still internalized what it means to “put patient safety above all else” and even though I never took the hippocratic oath, nothing matters more to me than the safety of our patients. This isn’t the first time we’re seeing this either. We all remember the whole “Cerebral” debacle. I personally know these people. These operators clearly BROKE THE LAW and prioritized dollar signs over doing what is right. It breaks my heart that the individuals that run these companies would compromise the integrity of telemedicine by acting in their own interests—instead of the interest of patients. As someone who has been in the telemedicine space for 7 years, it’s saddening and frustrating that bad actors are giving telehealth a negative reputation. Telehealth has been a turning point in our healthcare ecosystem: it’s a critical means that expands a provider’s reach and efficiency. Not to mention that patients demand innovative healthcare solutions. But how do we protect the population? There’s no question that the prescribing of addictive, high risk controlled substances needs oversight, but we can’t let what happened here stifle the progress of legitimate healthcare innovation. I agree that people who exploit the healthcare system need to be brought to justice–however I hope that instances like this don’t result in telehealth more broadly getting a bad rap! https://lnkd.in/gQ4btenk
