The ASC announces that Ronald James Aitkens was sentenced today to four years in jail for fraud and misleading statements by the Alberta Court of Justice. After being found guilty, he failed to appear for sentencing in November 2023, and a Canada-wide warrant was issued for his arrest. Aitkens was arrested in Montana, U.S. and returned to Canada on August 8, 2024. Cynthia Campbell, Director of Enforcement at the ASC said that “this sentence clearly demonstrates that those who defraud investors will face consequences for their actions no matter where they try to hide.” https://lnkd.in/gBanExn6

Dennis Michael Lynch Kangaroo court. The Dishonorable Juan Merchan has instructed the jury they do not need to have a UNANIMOUS verdict in order to convict DJT. There is no need to agree on what has occurred. They can disagree on what the crime was among three choices. This means they could split 4– 4–4, and the judge would still treat them unanimously. What does that mean? In a normal criminal case every statutory crime has what is called “elements of the offense.” Like in a bank robbery case — you have to rob, and it has to be a financial institution, and you have to show intent. Those are the things the jury has to agree on unanimously; that it was proved beyond a reasonable doubt. With Merchan, what he is doing is removing the element that actually makes this a felony because falsification of records is normally a misdemeanor in New York. What makes it a felony is that you are concealing or committing another crime. And Merchan is telling them they don’t have to agree about what the other crime is under circumstances where not only is it what makes it a felony, but makes it a four year potential prison penalty rather than a year or less, and it is also what got the case into the courtroom to begin with. If this had been a misdemeanor the time to bring this case would’ve lapsed in 2019. The only reason they are still able to bring this case is because it’s a felony allegedly and yet now the judge is saying you, the jury, don’t have to agree on what the felony is. Insane! When I made the move to Federal Government it was not without a lot of thought about my career direction and focus. The creative me worried: "Would this role bring enough creative opportunities to satisfy me?" The manager me worried: "Can I deal with layers of frustrating bureaucracy on a daily basis?" Ultimately it was the justice warrior me who convinced me to quiet those concerns and focus on the big picture, the good I could do, the small role I could play in bringing criminals like this to justice. (Also have to add that the flexibility at a time my family needed it most was an added bonus.) I'm thankful that voice convinced me to make the move. Playing a small role in bringing cases like this to trial, and ultimately a guilty verdict, brings the term "purposeful work" home. At the end of a long day, a difficult day, a frustrating day that purpose is worthy and satisfying. Also, last but certainly not least, the Federal trial teams share my outlook. The dedicated, intelligent, insightful, kind, and yes, creative people I work with never fail to inspire me to push to a creative solution that will help tell the story, explain the often complex schemes and how/why the law(s) were broken. This case...ugh. So. Many. Innocent victims. It's heartbreaking. But. The agents and lawyers were relentless in bringing justice. The result is one less scammer manipulating and robbing innocent people. Maybe not as fun as selling the allure of a new shade of lipstick or creating the images of a fun night out drinking an adult beverage (and certainly not with those kinds of budgets), and certainly not as "cool," and the accolades are not doled out at swanky banquets and lauded and dissected in marketing symposiums, but for me: using my creativity to prosecute people like this is infinitely more rewarding.

A result acheived by possibly the most intelligent lawyer I’ve ever worked with.
https://lnkd.in/euj2jcQp “Stephen Bear has consistently shown no remorse throughout the proceedings, despite the knowledge his actions had serious impact on the victim. At every turn, he has sought to conceal his earnings and assets. “I am proud of the efforts of the CPS Proceeds of Crime team, working with financial investigators from Essex Police, to prove the full financial benefit of Bear illegally uploading to the internet. “Today’s Confiscation Order shows our determination to continue to pursue proceedings following conviction and ensure he has not profited in any way from his selfish actions.”
