There are two compensation options available to survivors of childhood sexual abuse in Australia. They are the National Redress Scheme (‘NRS’) and a civil common law claim. The compensation payable under each option varies significantly. The NRS compensation is capped, whereas a common law claim will usually result in a significantly higher award If you’re a survivor of child sexual abuse and are considering claiming under the National Redress Scheme, we strongly recommend you seek legal advice first. Your specific circumstances may very well mean that a common law claim is at least an option you need to consider, which may entitle you to substantially more compensation for the harm you have suffered. https://bit.ly/4aCw7h8 #childsexualabuseclaims #abuselawyer #childsexualabusecompensation #nationalredressscheme

Have you ever considered how child support can be used as a weapon in cases of domestic violence? One Kansas woman shared her own experience of being urged to take out a case against her abuser despite voicing her concerns and reluctance. It's important to remember that each case is unique and requires careful consideration of all parties involved. Kansas Republican Reprisentive, Francis Awerkamp, says “it’s an oppertunity to find that other parent and make sure they’re doing their duty”. The need to engage Territorians in decisions about changes to laws, policies and programs was raised by several Members of the NT Parliament this week. More than 200 people signed on to an open letter earlier this month calling on the new NT Government to listen to and work directly with communities to develop effective solutions that address alcohol harms: https://lnkd.in/ghnrSXtQ The open letter stressed the need for decision makers to adopt an evidence-based prevention approach that puts the health, wellbeing and safety of Territorians first. We know all too well what happens when decisions are quickly made without community engagement and consideration of the evidence. It's vital that the NT Government consult with communities and experts in alcohol harm reduction to develop solutions that will prevent violence and save lives. #NorthernTerritory #AlcoholHarms #PublicHealth

Leading Edge News from Queensland! The Queensland Government has taken a crucial step forward in recognising coercive control as abuse. Under new legislation, coercive control is now acknowledged as a form of domestic abuse, and criminal charges can follow. This is a significant stride towards creating safer environments and providing justice for victims. Coercive control involves behaviors aimed at dominating and controlling someone through various tactics, often non-physical, such as financial control, manipulation, and intimidation. It can have severe and lasting impacts on victims' mental and emotional well-being. By criminalizing coercive control, The Queensland Government is sending a powerful message that all forms of abuse will be taken seriously. This legislation reinforces the commitment to protect individuals from harmful relationships and fosters a culture where everyone feels safe and empowered. This amendment was made after an inquest handed down its report on the shocking domestic violence murders of Hannah Clarke and her 3 children. As someone who is championing the advocacy for women to feel safe and heard in relationships, I am really proud to see the steps the Queensland Government has made to recognising all forms of abuse. Kudos to the Queensland government for their proactive stance in addressing domestic abuse comprehensively. If you or someone you know is experiencing domestic abuse or violence, please reach out to a local helpline or support organisation. Remember you are not alone and there is always help available. #CoerciveControl #DomesticAbuse #QueenslandLegislation https://lnkd.in/gUTrbjxV

Member for Wanneroo | Minister for Early Childhood Education; Child Protection; Prevention of Family and Domestic Violence; Community Services
Today, the Attorney General John Quigley and I announced the introduction of the Evidence Bill 2024 into State Parliament. As Prevention of Family and Domestic Violence Minister, I am proud that the Cook Government is introducing this crucial reform to Parliament. The reforms will ensure that victim-survivors of family and domestic violence are supported through the court process. As part of this Bill, audio and/or visual statements recorded at the scene of the event or shortly after will be admissible as a complainant's evidence in chief. This will reduce the need for victim-survivors to retell their stories - something that can be deeply challenging and retraumatising. These reforms will also support family violence and child sexual abuse victim-survivors by increasing the opportunity for them to access other witness assistance measures, such as a support person or support animal. This is another practical action that our Government is taking to support victim-survivors. We will continue to put the safety of victim-survivors first.

📣 Your Voice Can Make a Difference: End the Voluntary Intoxication Exclusion Did you know? The current legislation in New York State leaves numerous survivors of sexual assault unprotected due to the "Voluntary Intoxication Exclusion." Individuals sexually assaulted while voluntarily intoxicated are denied the same justice 🚫⚖️ as those assaulted under involuntary intoxication. This outdated law significantly hampers justice for survivors who chose to consume alcohol or substances before their assault. The New York State Coalition Against Sexual Assault and our fellow #JusticeWithoutExclusion coalition members are championing a movement to support Assembly Bill A1065 and Senate Bill S4555. The moment to advocate for legislation that protects all survivors, regardless of their intoxication status, is now 🗽✊. As part of the government’s Domestic Violence Disclosure Scheme (DVDS) also known as Clare’s Law, “Right to Ask” recognises that the majority of domestic abuse occurs from repeat offenders. It champions the right of all people to know if they’re in a relationship with someone who has a history of abuse with the aim of preventing cases of domestic abuse. Today is a landmark day for our communities' understanding and attitude toward domestic and family violence. From today, victim-survivors of domestic, family and sexual violence have stronger protections in New South Wales, with the criminalisation of coercive control and stronger bail laws coming into effect. So, what is coercive control? "Coercive control is a pattern of behaviours used by a person to dominate and control their partner or family member. It can involve surveillance, insults, withholding money, and physical violence or threats. It's been described as making you feel as though you're constantly walking on eggshells." Source: ABC News By setting coercive control laws, NSW has drawn a clear line of unacceptable behaviours that have been a grey area for decades. As a state, we say these behaviours will no longer be tolerated. While coercive control is predominantly discussed in the context of intimate partner relationships, it can exist in any interpersonal relationship. It is a foundational behaviour in elder and child abuse and, therefore, will have widespread benefits throughout our communities for setting agreed-upon standards of respectful relationships. #RunAgainstViolence #EndFamilyViolence #coercivecontrol Kirrily Dear Kerrie Edwards Bsc GAICD
