Ship recycling again: an important intervention by BIMCO today, which has submitted a paper to the International Maritime Organization, calling for an enhancement in legal certainty for owners of end of life ships, in view of the potential for both the incoming Hong Kong Convention and the long-established Basel Convention to apply. As almost the whole world (with the notable exception of the USA) is a signatory to Basel and fewer than 25 states have currently signed up to the HKC, it is fair to wonder what the IMO can do about this, and whether it might be (more?) sensible to focus on the Basel Conference of Parties, due to meet a few weeks before the HKC comes into force in mid-2025. Between a proposal and a law - there are only 854 days! Last week, the Corporate Sustainability Due Diligence Directive (#CSDDD) was officially published in the EU's Official Journal. This is a significant milestone in ensuring corporate accountability for human rights and environmental impacts. But what does it actually mean? 🧐 The CSDDD will come into force 2️⃣0️⃣ days after publication (or 16 days from today), marking a crucial turning point for EU supply chain legislation. EU countries have 2️⃣ years to integrate it into their national laws. 📆 Companies will be required to comply starting in Q3 2027, with a phased implementation based on company size. I had the privilege to have a very Insightful meeting at the US Department of Commerce - Office of Materials Industries as part of the international delegation during AMPP Advocacy Day. The meeting generated great conversations between the delegation members and the DOC International Specialists about the benefits of Quality Standards in the global industry and its contribution to assets integrity public safety, environmental protection and Sustainability. Other topics of interest as workforce development, supply chain, and emerging technologies were discussed at a high level to address main challenges and look for common grounds with AMPP to support emerging markets. Day 2 with the Responsible Business Alliance conference in Berlin, the focus is on collaboration in raw materials due diligence. The first keynotes of the day were Ministers Svenja Schulze and Hubertus Heil with a focus on the much discussed Due Diligence Directive and the German Supply Chain Act. The European Due Diligence Directive has received a lot of attention lately due to its concessions. It was refreshing to hear some dedicated voices bring passion back to the debate, supplemented with the voice from a representative from Industrial Workers Federation of Myanmar. Key points paraphrased: 🚸 We still live in a world where children work in cobalt mines, and workers stand barefeet in chemical sludge. Decent companies that care about the conditions in their supply chains should not be at a disadvantage: the due diligence law will help level the playing field. 💰 For free trade to be fair, it must be sustainable. 👨🔧 Most violations may happen in the indirect supply chain; how will the new law impact these situations? People often inquire about identifying truly Indigenous businesses. For me, it's about looking at key factors - where the business is located, who answers the phone, who pays the staff, and who procures the stock. Consider this example: Countryman Safety is a certified Supply Nation business, yet its address matches Safeman Australia's. Hiding behind a capability partner scenario. Contrasting with others in the industry who manage their own stock, staff, and premises, these discrepancies raise questions. I'm committed to addressing these disparities as progress requires leadership and industry cleanup. Identifying and rectifying such situations is crucial for the integrity of our business community.
