Listening Attentively. Imagine plight of a trial court judge. He has to sit about 5 hours, in middle of lawyers and litigants. Everyone is watching his every action. He cannot even sneeze or yawn without being noticed. And he has to listen attentively. He has to figure out what this lawyer is trying to say, without being distracted by the different noises coming from the other lawyers in the room. And then, he has to pass orders. His orders need to be carefully worded. So that they stand even if they are scrutinized by superior court judges and litigants. He needs to be correct on facts and correct on prevailing precedents of law. An in the process, he develops ability to "Listen Attentively". Mastery in listening well is required in legal profession. Law students, If you are going into trial work, you need to lose jargon and legal speak. Jargon is part of every profession, trade, and occupation, but it is specific to those areas and isn't helpful for communication with those not part of the group. Legal speak makes you sound like a lawyer. Prized by law schools and appellate courts, legal speak is a death blow to your case. Juries are not made up of law professors and appellate judges. Jargon and legal speak - the temptation to use both is real. Don't. #lawstudents
