Did you know you can qualify for a Road Accident Fund (RAF) claim for up to three years after an accident? In South Africa, this is the general rule. However, there are certain exceptions where a claim may still be valid beyond this period or have a different prescription period. When and Why an Accident Could Qualify for a Claim After 3 Years: Minor Claimants: If the claimant was a minor at the time of the accident, the prescription period only starts once they turn 18. This means they have until their 21st birthday to file a claim. Mental Incapacity: If the injured party was mentally incapacitated due to the accident, the three-year period may be extended. The claim must be filed within three years after they regain their mental capacity. Unknown Identity of the Wrongdoer (Hit-and-Run Cases): If the identity of the wrongdoer is unknown, the claim period is reduced to two years. The claimant must show they were unable to identify the wrongdoer despite reasonable steps to do so. Other Legal Exceptions: There are additional exceptions based on specific circumstances, such as claims involving minors or persons with legal disabilities, which can extend the prescription period.
