As a healthcare regulator, I was part of the problem. As someone considering law school, I’ve been reflecting on how mental health is handled in other professions—particularly in law. Does the legal profession need to rethink how state bars address mental health issues? Many years ago, a conversation with Dr. Brett Kessler, American Dental Association president and in recovery from a substance use disorder, challenged me to consider whether outdated licensing practices perpetuate stigma. In healthcare, intrusive “Have you ever…” questions deter honesty, discourage treatment, and can ultimately harm the public. Inspired by the Dr. Lorna Breen Heroes' Foundation and my friend Brian Cuban’s advocacy, I wonder if law could benefit from the changes we’ve made healthcare: shifting to an attestation model that prioritizes current fitness to practice. Words matter, and I thank the legal teams that helped to make these changes happen in healthcare! I have seen some of the changes being made at various state bars. Many of the questions are still stigmatizing and overly broad. A close friend shared with me that he was encouraged by our licensing renewal changes to get help for his suicidal ideations and substance use. His life has changed! Mental health challenges are complex, with many causes and many solutions. I push the American Bar Association to keep making change happen. Keep the conversations going!
