While a series of U.S. flag inland push tugs were under construction, ABS was asked to verify compliance with Subchapter M. Due to the vessel’s configuration, the shipyard could not conduct the inclining experiment as there was inadequate space on the main decks for incline weights, and the deckhouse structures were not built to support incline weights. Tugs, barges, and ships are exposed to unique risks while transiting inland waterways, and the proper management of inland waterway transportation is vital for cargo safety and risk mitigation. Claims resulting from delays, salvage equipment costs, tugs, underwater surveys, etc., can be substantial, and the preparedness of equipment and vigilance/preparedness of mariners are crucial to preventing losses and mitigating exposure if an incident occurs. The American P&I Club maintains an "Inland Waterways" webpage featuring best practices guidance documents that address ship anchoring and mooring considerations in U.S. rivers during high water conditions and barge fleeting area issues. “You may have seen many a quaint craft in your day, for ought I know; - square-toed luggers, mountainous Japanese junks; butter-box galliots, and what not; but take my word for it, it is at times not an easy quest to define what makes or does not make a floating craft a ship. The application before me raises this perennial question, viz, what makes a vessel a “ship” for the purposes of validly invoking the court’s admiralty jurisdiction? It might come as no small surprise to some but this deceptively simple question is one which there appears to be no clear (and some might argue, consistent) answer in the wealth of jurisprudence on this topic amongst the courts in the Commonwealth.” The Singapore High Court had the opportunity to consider for the first time this seemingly simple but complex question in the context of a barge which has been converted into a floating fish farm. My team (Vicki, Fiona & Sourish) and I had the pleasure of successfully assisting the court in deciding this issue in our client’s favor citing cases from England, Ireland, Australia, Canada and Singapore … drawing up parallels and identifying practicable common factors used by the courts in these various jurisdictions. The decision sets out how the inquiry should be a multi-factorial approach based on a non-exhaustive list of ship-indicia factors. It also clarified that the infrequency of actual movement across water should not affect the court’s assessment of the vessel’s navigability, i.e. whether the vessel is capable of being used in navigation. #highcourt #shipping #admiralty #law #legal #singapore
