Without a comprehensive incapacity plan, if you become incapacitated and unable to manage your affairs, a judge will need to appoint someone to take control of your money and property (known as a conservator or guardian of the estate) and to make all personal and medical decisions for you (known as a guardian or guardian of the person) under court-supervised guardianship and conservatorship proceedings. The guardian and conservator may be the same person, or two different people may be appointed to these roles. Depending on state requirements, the conservator may have to report all financial transactions to the court annually or at least every few years. The conservator is also typically required to obtain court permission before entering into certain financial transactions (such as mortgaging or selling real estate). Similarly, the guardian may be required to obtain court permission before making life-sustaining or life-ending medical decisions. The court-supervised guardianship and conservatorship are effective until you either regain the ability to make your own decisions or you pass away. Have you planned for incapacity? The left-leaning legislature continues to undermine parental rights. Public school children now have the right to choose a non-legal name that reflects their gender identity. If anyone working in a school doesn’t comply, they can be charged with discrimination. School boards will decide whether parents are notified of the name change." Understanding Colorado HOUSE BILL 24-1039, is a legislative proposal that aims to create a more inclusive environment for students in Colorado schools by recognizing their chosen names. Key Points of the Bill: Chosen Name: Students can be addressed by a name that reflects their gender identity, different from their legal name. Gender Identity: Acknowledged as an individual’s innate sense of their own gender, which may not align with their sex assigned at birth. Usage in Schools: School personnel must use students’ chosen names in all school-related settings and activities. Anti-Discrimination: It’s discriminatory to intentionally use a different name or avoid using a student’s chosen name. Reporting Mechanisms: Students can report discrimination to their school or through Title IX policies. Policy Requirements: Schools must establish policies to respect students’ chosen names, including on school records, in compliance with federal privacy laws.
