Consumers are increasingly concerned about their environmental footprint and are more inclined to make sustainable choices when selecting products and services. Recognizing this trend, many businesses genuinely aim to operate more sustainably and make authentic environmental claims about the products they sell. Under the Australian Consumer Law, businesses are obligated to avoid making false or misleading representations and engaging in deceptive conduct. This year, as part of its compliance and enforcement priorities, the ACCC is giving priority to consumer, product safety, fair-trading, and competition concerns related to environmental and sustainability claims. With environmental and sustainability claims on the ACCC’s enforcement radar, businesses must ensure that their environmental and sustainability claims align with the ACL. Fortunately, in December 2023, the ACCC released new guidance on making environmental claims in compliance with the ACL. We asked our members about the biggest challenges they face. The top two were: 1. The costly and complex process of securing regulatory compliance, which is essential to keep the industry and customers safe. 2. Tackling greenwashing and greenhushing. The latter occurs when companies under report or withhold information about their environmental efforts and achievements.

This #EarthDay we’re reminding businesses to read our guidance for making environmental claims. This guidance outlines our view of what businesses need to do when making environmental claims to comply with the Australian Consumer Law and our expectations for good practice when making these claims. Some businesses have already responded. These businesses often advertise in a clear and transparent manner, where as others still potentially could be misleading. To assist, we’ve identified a series of eight practical principles which we encourage businesses to apply when making environmental claims. Keller and Heckman Senior Counsel Peter de la Cruz and Partner Sheila Millar authored the Environmental Law Institute article, “Why Sustainability Needs Antitrust.” The article demonstrates that “Antitrust is not an enemy of sustainability goals, but an essential companion and helpful analytical tool in determining the optimum balance among sustainability’s goals.” Peter and Sheila argue that there is a strong relationship between sustainability and antitrust, and that antitrust is needed to maintain modern markets that support competitive-driven efficiencies and innovation.
