Consumers are increasingly concerned about their environmental footprint and are more inclined to make sustainable choices when selecting products and services. Recognizing this trend, many businesses genuinely aim to operate more sustainably and make authentic environmental claims about the products they sell. Under the Australian Consumer Law, businesses are obligated to avoid making false or misleading representations and engaging in deceptive conduct. This year, as part of its compliance and enforcement priorities, the ACCC is giving priority to consumer, product safety, fair-trading, and competition concerns related to environmental and sustainability claims. With environmental and sustainability claims on the ACCC’s enforcement radar, businesses must ensure that their environmental and sustainability claims align with the ACL. Fortunately, in December 2023, the ACCC released new guidance on making environmental claims in compliance with the ACL. This guidance outlines our view of what businesses need to do when making environmental claims to comply with the Australian Consumer Law and our expectations for good practice when making these claims. Some businesses have already responded. These businesses often advertise in a clear and transparent manner, where as others still potentially could be misleading. To assist, we’ve identified a series of eight practical principles which we encourage businesses to apply when making environmental claims. Consumer, product safety, fair trading and competition concerns in relation to environmental claims and sustainability is a current priority for the ACCC.
