Today the Federal Trade Commission published modifications to the Horse Racing Integrity and Safety's Assessment Methodology, the ability to charge interest on past due assessments, and other modifications that appear to be aimed at short-circuiting issues in pending federal court cases. The Assessment Methodology is the formula used to calculate fees the HISA Authority charges against racetracks, owners, trainers, and jockeys in the industry to regulate their industry. Opponents of the proposed modifications on the Assessment Methodology have stated the modifications prejudice smaller racetracks with more live race days and smaller purses by using a straight number of races basis versus accounting for purse monies being raced for in those races. Although the opposition was noted in the published document, the Federal Trade Commission disagreed with opponents stating purse dollar amounts had no relevance to the assessment. Also of interest is the fact that the Commission provided for interest on past-due assessments and agreed with Penn Entertainment's submitted comment that Interest should not include points and should be calculated at a prime rate. In the final version the interest rate is the prime rate published in the Wall Street Journal on the date the payment is due, compounded annually, charged on the amount from the due date of the payment until that amount is paid. #thoroughbredracing #horseracing #HISA #federallaw https://lnkd.in/gS93UBDy

Recently, the United Pickleball Association of America (UPA-A) introduced an annual paddle certification fee of $20,000, a significant reduction from the previously rumored $100,000. However, this fee still places considerable pressure on small to mid-sized paddle manufacturers. Furthermore, UPA-A's interim certification program has faced backlash from several manufacturers, including Selkirk, due to concerns over fairness. The approval of JOOLA paddles, which had previously been delisted by USAPA for core-related issues, has also raised questions about UPA-A's transparency and integrity. Given these controversies, the question remains: how many manufacturers will choose to pursue UPA-A certification under such conditions? The credibility of the certification process is crucial for its success, and the current doubts may deter brands from investing in it.
