EPA Begins Process to Prioritize Five Chemicals for Risk Evaluation under TSCA The U.S. Environmental Protection Agency (EPA) announced that it is beginning the process to prioritize five additional toxic chemicals for risk evaluation under the nation’s premier chemical safety law. If, during the 12-month long statutory process, EPA designates these five chemicals as High Priority Substances, EPA will then begin risk evaluations for these chemicals. EPA plans to prioritize the following chemicals for risk evaluation under the Toxic Substances Control Act (TSCA): 1. Acetaldehyde (CASRN 75-07-0), 2. Acrylonitrile (CASRN 107-13-1), 3. Benzenamine (CASRN 62-53-3), 4. 4,4’-Methylene bis(2-chloroaniline) (MBOCA) (CASRN 101-14-4), and 5. The U.S. Environmental Protection Agency’s (EPA) was active in 2023 taking notable regulatory actions on per- and polyfluoroalkyl substances (PFAS), including regulating chemical manufacturing and use under the Toxic Substances Control Act (TSCA). Last year’s regulations and associated requirements may require significant compliance costs and effort from covered entities, and additional actions are expected in 2024. Industries impacted by these regulatory actions, including under TSCA, should familiarize themselves with all revised reporting requirements and be prepared to satisfy them prior to new deadlines. The U.S. Environmental Protection Agency proposed a rule that has, thus far, flown under the radar. This rule continues the EPA’s push to require chemical manufacturers and importers to report to the EPA. It also requires manufacturers and, significantly, article importers to report unpublished health, safety and environmental studies that companies have of 16 chemicals — including benzene and styrene — over the past 10 years.
