Did you know that there were an estimated 734,630 rapes in the U.S. in 2018? According to the National Sexual Violence Resource Center, 81% of women and 43% of men report experiencing some form of sexual harassment and/or assault in their lifetime, and a third of female survivors experienced an attempted or completed rape between the ages of 11 and 17. Started the day way earlier than usual, and jumped on two ABC programs before 8am. This interview with Patricia Karvelas is especially close to my heart - covering coercive control, the many and horrifying impacts it has on children, and the capacity of our systems to protect and empower kids who grow up with it. This conversation relates particularly to the murder-suicide in Lismore, in which James Harrison murdered his two-year-old son Rowan. When James was late returning Rowan (who was on a weekend access visit) to his mother, and would not return phone calls, Sophie Roome was alarmed. There was a domestic violence order in place naming Dr Roome as the protected person, and she had reason to be alarmed. At that stage there were multiple concerns: had he taken off with Rowan? Was this now a missing person case? When police went round to the house and got no response, they left. Hours later, after Dr Roome and family members had pleaded with police to go back to the house, police finally forced entry four hours later and found James and Rowan dead. I can't comment on this case specifically, but I've been told by countless protective mothers - and the kids on court ordered visits - that they've called police about safety concerns or reported *actual abuse and violence*, only to be told by police that they can't intervene, because it's a 'family law matter'. If the police delayed their response in this case because of this same old trope, there should be serious consequences. What is the harm to police in erring on the side of caution, and taking the fear of women and kids seriously? Especially when the child access is occurring in the context of an active domestic violence order? There is little that enrages me more than the failure to protect children in the family law system. We need to start protecting children in these systems the same way we would want our own children to be protected. Emotions such as guilt and shame motivate us to keep our actions in line with normative expectations and are therefore essential in regulating our social and moral lives. In ‘Guilt, Shame and Juvenile Delinquency’ Arne De Boeck (Arne D.) researches how both emotions work as deterrents to criminal behaviour in juveniles. He provides a compelling argument to consider guilt and shame as part of the etiological underpinnings of juvenile delinquency. In a comprehensive review of the criminological literature on the relationship between shame, guilt and offending, he integrates both emotions into a symbolic interactionist theory of delinquency.. I am honoured to have been a panel member at the recent event hosted by the National Centre for Action on Child Sexual Abuse, where we explored what a justice system designed to serve the needs of victims and survivors would look like. During our discussion, we delved into the barriers to justice, the meaning of justice for victims and survivors, and the obstacles to implementing a restorative approach. It was a powerful conversation that brought together diverse perspectives from research, lived experience, cultural understanding, and practice knowledge. At Yarn Legal, our mission is to provide trauma-informed and culturally safe legal services that account for the realities and impacts of trauma on our Aboriginal and Torres Strait Islander clients. Trauma-informed lawyering recognises that many of our clients have experienced traumatic events like abuse, violence, discrimination, or systemic injustices. These traumatic experiences can profoundly shape how clients engage with the legal system and their ability to recount their stories and navigate legal processes. A trauma-informed approach means we come to the work from a place of not judging but listening and respecting our clients' lived experiences. We adjust our practices to avoid re-traumatisation and build trust through compassionate, culturally responsive services. As an Aboriginal-owned legal practice, cultural safety is at the core of how we deliver trauma-informed services. We understand that for many Aboriginal and Torres Strait Islander peoples, the legal system itself can be a source of intergenerational trauma due to histories of oppression, discrimination, and family separations. Providing a culturally safe environment where clients' identities are respected and they feel empowered to share their stories is essential. By centering trauma-awareness and cultural safety, we aim to reimagine what the justice process can look like for Aboriginal and Torres Strait Islander victims and survivors. Rather than re-traumatising people through alienating systems, we walk alongside our clients with deep understanding, upholding their self-determination and paving pathways to healing.
