IRS ERC Moratorium Update: Declaration of Douglas O'Donnell - "33. Knowing the significant risk of the paper claims in inventory, we will process claims that have the highest risk of ineligibility, looking on a first-in first-out basis starting with claims filed before the #moratorium, by issuing notices of claim disallowance. We also will process claims that have the lowest risk of ineligibility, also looking on a first-in first-out basis starting with claims filed before the moratorium, by providing either a full allowance or a partial disallowance of the claim. The processing of those claims will occur over the summer. We expect the pace to go slowly and judiciously as we continue to refine our analytical tools." #erc

After 10 months (arguably more) of not processing any ERC claims, the IRS is now issuing letters denying some claims. But here's the problem: the letters are full of errors; they are not giving a reason for the denial; and they are not including the steps to appeal the decision. For example, the IRS will reject a claim for not having a certain box checked on the 941-x, but the box was actually checked. If you receive one of these letters, contact a professional immediately so you don't miss any deadlines.

It will be fascinating to see how the IRS distinguishes ERC “hardship cases” (worthy of immediate processing) from the many other ERC filer (who are apparently just fine operating indefinitely without the credits to which they are entitled).

IMPORTANT REMINDER: The ERC voluntary disclosure program (VDP) ends on March 22. VDP is for a limited time only and as the IRS points out in their recent reminder, it offers a method of withdrawing an invalid claim at a discount without penalties or interest. Learn more >> https://hubs.ly/Q02q8dY_0
