Being charged with retail theft or shoplifting is an upsetting experience. Like theft under other circumstances, the prosecution must prove you intended to permanently take the item in question without paying for it as part of its case. Retail staff have increasingly been subjected to violence and abuse, partly as a result of the growth in shoplifting, prompting calls from the industry and unions for a new offence of assaulting a shop worker; but Penelope Gibbs, Director of campaign group Transform Justice, warns that the a move would do nothing to reduce the number of attacks, suggesting that a better police response to such assaults and perpetrators dealt with out of court where possible would be much more effective. ❝The retail industry is concerned about shop staff and independent shopkeepers who are victims of abuse and violence because they care, and because they are concerned that shop staff – who are often lowly paid – will walk.❞ ❝Someone who shoves a police officer without injuring them physically in any way can get imprisoned for two years, while someone who shoves a shop worker couldn’t be imprisoned for more than six months.❞ ❝Recently Tiffany Lynch, Deputy Chair Police Federation of England and Wales said: ‘I’d love to say that tougher sentencing has had a positive effect on reducing the number of assaults on officers, but it hasn’t.’❞ ❝The greatest need of victims is to be listened to, and for the crime to be resolved in some way. You both have a knife? Do you usually posses a knife? Where’d you get that from, mum’s kitchen? These are some of the questions asked by police during an intercept of a number of youths who are found carrying a knife at a public train station. These youths are “wanded” which is a relatively new process whereby police are permitted to wave a mobile, hand held metal detector over a persons body in authorised locations. During recent wanding operations, 904 people have been charged with almost 1600 offences. Under proposed new laws aimed at protecting the community and curbing youth offending, it will become an offence to sell knives, certain other bladed items and replica firearms (including gel blasters) to juveniles. Retailers will also be required to securely store bladed items prior to sale and advertise age restrictions. Retailers and other small and large businesses who sell knives and other bladed instruments will have to keep a close eye on these proposed reforms to make sure they are compliant. 🎥qps #smallbusiness #lawyer #community
