Friendly Reminder regarding the Toxics Release Inventory (TRI) Program! Section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA) created the Toxics Release Inventory (TRI) Program, which requires owners and operators of certain facilities that manufacture, import, process, or otherwise use certain toxic chemicals to report annually their releases of these chemicals to each environmental medium. The TRI Program reporting criteria include: a) Federal facilities or facilities with primary North American Industry Classification System (NAICS) Code covered by the TRI Program; b) Facilities with 10 or more full-time employees; c) Facilities that manufacture, process, or otherwise use TRI-listed chemicals such as formaldehyde and lead; and d) Facilities that exceed any of the thresholds for a chemical or chemical category. For example, the thresholds for formaldehyde include 25,000 pounds manufactured or processed, or 10,000 pounds otherwise used; and the thresholds for lead include 10 pounds manufactured, processed, or otherwise used. Facilities that meet all TRI Program reporting criteria must submit TRI Form R for each TRI-listed chemical above reporting threshold to both EPA and the state in which the facility is located. If your facility meets the TRI Program reporting requirements, the TRI forms will need to be submitted by July 1, 2024, for the 2023 reporting year.
